on July 31, a New Jersey state appeals court removed Lana Leguia from the ballot. She is the Libertarian nominee for U.S. House, 7th district. She only has enough valid signatures of the ones collected by out-of-state circulators are included. Although the New Jersey law banning out-of-state circulators was struck down in 2021, that case concerned petitions for primary candidates, not general election candidates. The Secretary of State had put Leguia on the ballot but the State Court of Appeals ruling says the Secretary of State didn’t have the authority to set aside the circulator ban for general election petitions. See this story. The decision is stayed so that Leguia has time to appeal to the State Supreme Court.
A constitution can only be enforced by the people by balloting. If the balloting is corrupted by censorship and other devices, the courts cannot be relied on to enforce a constitution.
Libertarians can be constitutionalists IF people are able to enforce it. Otherwise a constitution becomes a farce. Banning candidates from voters is evidence of farcical constitution.
A constitution is possible that so limiting on the initiation of force that even most anarchists could tolerate it.
Libertarians can debate how such a minimalist constitution that bans taxation in any form could be structured.
