On August 13, Libertarian congressional nominee Lana Leguia filed a federal lawsuit against the New Jersey ban on out-of-state circulators in general elections. Leguia v Caldwell, 3:26cv-10263. Earlier she was kept off the ballot because she had used some out-of-state circulators. The New Jersey ban on out-of-state circulators for primary petitions had been declared unconstitutional in federal court in 2021, but the state courts refused to examine whether that decision also means that the ban for general election petitions should be disregarded.
The new federal case is assigned to U.S. District Court Judge Zahid Quraishi, a Biden appointee. He is the judge who enjoined the discriminatory ballot access format in primary elections in 2024.

Every state should decide on how they want their elections administered. The use of invaders from out of state to participate in their electoral process is a violation of their state sovereignty. We are supposed to be a republic. A republic where states decide individually how they want to administer their elections and electoral process. This is a clear state’s right issues. The federal government should not interfere or administer state elections.
If they dont want interference from political invaders, scalawags or carpetbaggers that is New Jersey’s prerogative.
The libertarian party has this false belief their 1st Amendment rights are being denied. The 1st Amendment doesnt extend to determining the electoral process of each state.

American citizens can travel throughout the USA and do not give up their constitutionally enumerated rights when they enter a different jurisdiction.
Asking a person to sign a petition to place a candidate or a political party or an issue on a ballot is free speech.
The court in New Jersey already affirmed this for major party primary petitions. The same standard ought to apply for minor party and independent candidate petitions.
