California Secretary of State Web Page Has Data on Americans Elect Petition Validity

The California Secretary of State has placed this chart on her web page. It shows how many signatures Americans Elect submitted on its petition to be a party, by county. If a particular county has already checked signatures (using a random sample), the chart shows the results. So far, the validity is at 76.8%, which shows that the petition is very likely to succeed. The chart will be updated daily. Not all counties have reported the number of signatures submitted, so as of today, the chart cannot be used to know how many signatures were submitted in the entire state. Americans Elect says it submitted 1,630,000 signatures to meet a requirement of 1,030,040.

Jury Selection in Case Involving Mayor Bloomberg and the Independence Party May Take a Week

On September 19, proceedings began in the criminal trial of John Haggerty, who is accused of taking over $1,000,000 in funds from the New York Independence Party and not carrying out the political work that he had contracted to do. He was supposed to help organize poll watchers on election day in November 2009 who would help Bloomberg’s campaign. Bloomberg had given the money to the Independence Party, and then the party had given the money to Haggerty. After the first full day, only five potential jurors had been identified. See this story. Ninth Circuit Says Idaho Primary Lawsuit is Moot

On September 19, the Ninth Circuit ruled that it has no jurisdiction to hear an appeal of the U.S. District Court decision Idaho Republican Party v Ysursa. In that case, on March 2, 2011, the U.S. District Court had ruled that if the Republican Party wants to exclude sympathizers of other parties from its primaries, it may do so. The state, which had lost this case, did not appeal, and changed its election law to let qualified parties close their primaries.

Voters in Idaho who did not agree with the U.S. District Court decision, and who had been permitted to intervene in the case while it was in the U.S. District Court, appealed to the 9th circuit. But the 9th circuit said, “As a general rule, if a challenged law is repealed or expires, the case becomes moot.”

Opponents of the closed Republican Party in Idaho are free to file a new lawsuit, alleging that the new law is unconstitutional, although such a case would probably lose. The new law permits parties that wish to retain open primaries to do so, and the other qualified parties in Idaho (Democratic, Libertarian, Constitution) are expected to retain open primaries for themselves.

Green Party Gets Close to Choosing Location, Date for 2012 Presidential Convention

On September 25, the Green Party national steering committee will begin voting on a location for the 2012 national convention. Baltimore and Sacramento have submitted bids. Both cities propose dates for the convention of July 13-15, 2012.

The Green Party 2008 convention was July 10-12. The party’s 2004 and 2000 national conventions were in late June.
