Connecticut Legislative Hearing on National Popular Vote Plan

On February 29, the Connecticut Joint Committee on Government Administration and Election took testimony on HB 6018, the National Popular Vote Plan bill. 25 people testified in favor, and no one testified against. Secretary of State Susan Bysiewicz testified in favor.

A news report about the bill said that the plan would not go into effect until 25 states had ratified it. That is not correct. If the eleven most populous states ratified it, it would have the required electoral college majority and would take effect.

11th Circuit Will Rule on Florida Party Rights Case

The 11th circuit will hear the DeMaio case on March 17. This is the case in which a Florida voter sued both the state Democratic Party, and the national Democratic Party, over the rules that effectively prevent any Florida Democrats from having a voice in this year’s national convention. The U.S. District Court had ruled that the national party has a right to refuse Florida any delegates. Thanks to Rick Hasen for this.

Missouri House Passes Bill Moving Independent Deadline from July to March

On February 28, the Missouri House passed HB 1310 by a vote of 94-40. It moves the petition deadline for all independent candidates from late July, to March. The bill now goes to the Senate.

The Missouri independent candidate petition deadline back in 1976 had been in April, but a US District Court that year struck it down, in McCarthy v Kirkpatrick. The state did not appeal and moved the deadline to August. A few years later it was moved to July.

Thus, the bill is unconstitutional. It is also unconstitutional under Anderson v Celebrezze, the US Supreme Court decision of 1983 that struck down Ohio’s independent presidential petition deadline of March 20. Ron Paul & Dennis Kucinich Way Ahead for Reelection

Polls released yesterday and today show that Ron Paul and Dennis Kucinich are well ahead in their reelection campaigns. Both polls were conducted by Public Policy Polling.

Ron Paul leads his only GOP opponent, Chris Peden, 63-30%. He has no Democratic Party opponent.

Dennis Kucinich leads his Democratic opponents with 55%, over 29% for Joe Cimperman. Three other candidates register 5% or lower.
