Procedural Win for Plaintiffs in Alabama Lawsuit Over Access to List of Registered Voters

On June 23, U.S. District Court Judge Myron Thompson, a Carter appointee, refused to dismiss part of the lawsuit Greater Birmingham Ministries v Merrill, m.d., 2:22cv-205. This is the case over access to the list of voters who have been purged. The case is based on the federal voting rights act.

The state had tried to persuade the judge that the federal Voting Rights Act doesn’t apply, because the Act only talks about a “photocopy” of the list of registered voters. The state said the plaintiffs want an electronic copy, and the Act doesn’t mention electronic copies. Of course, when the Voting Rights Act was passed in 1965, there was no such concept. But the judge denied the state’s request.

Pennsylvania Bill for an Earlier Presidential Primary Moves Ahead

On June 22, Pennsylvania SB 428 passed the House State Government Committee by 16-8. It moves the primary for all office, but only in presidential years, from the fourth Tuesday in April to the third Tuesday in March. The bill passed the State Senate unanimously back on December 14, 2021.

If the bill passes, it will have no effect on the petition deadline for independent candidates and the nominees of unqualified parties.

Lawsuit Filed in Alaska State Court to Restore a Fourth Candidate to the Special General Election

According to this story, a lawsuit to force the Alaska Division of Elections to put four candidates on the August special general election, instead of three, has already been filed. Supporters of New U.S. House Districts for Louisiana File Briefs with U.S. Supreme Court

The NAACP has filed this brief with the U.S. Supreme Court in Ardoin v Robinson.

Both briefs make the case that there is no need for the U.S. Supreme Court to stay the orders of the lower federal courts that Louisiana must draw two black-majority U.S. House districts. Louisiana has no congressional primaries. There is no voting in Louisiana for congress until November.

North Carolina Greens Receive Evidence that an Organized Democratic Party Operation is Phoning Signers of the Green Party Petition and Asking Them to Remove Their Names

The North Carolina Green Party has received information that an organized Democratic Party group has the list of persons who signed the 2022 Green Party ballot access petition, and Democrats are phoning the signers and asking them to retract their signatures. It is too late for the Green Party to be adding any new signers. The counties have already checked the signatures and the Green Party has enough valid signatures. There is no provision in the North Carolina election code for signers to retract their signatures from a party petition.
