New York Voters Sue Governor over Delay in Calling a Special Election in the U.S. House 27th District

On December 11, several voters sued New York Governor Andrew Cuomo over his failure so far to call a special election to fill the vacant U.S. House seat, 27th district. One of the plaintiffs is the chair of the New York Republican Party. The seat has been vacant since September and there is still no special election date.     Benjamin West, one of three chosen from NH declined to serve, requiring a special election on June 22, 1789.

    Theodore Sedgwick was not elected until a 5th Trial on May 11, 1789.

    Representatives from New York and New Jersey were not elected until after March 4, 1789.

    Representatives for NC and RI were elected some time after their ratification of the Constitution.

    So in all these cases there were vacant positions. There were likely others who had been elected but not yet taken the oath of office.

    Perhaps you were thinking of a situation like Theodorick Bland of Virginia who died June 1, 1790, and was replaced by william Giles in a special election in July 1790.

    When was first USA Representative vacancy?

    If no one had been elected before March 4, 1789 was the seat vacant?
