Fifth Circuit Agrees with U.S. District Court that Louie Gohmert and Arizona Candidates Lack Standing

On Saturday evening, January 2, the Fifth Circuit issued a one-page opinion in Gohmert v Pence, 21-40001. They agreed with the U.S. District Court that the plaintiffs, Congressman Louie Gohmert and the Arizona Republican presidential elector candidates, lack standing to challenge the constitutionality of the 1887 electoral vote act. The appeal had been filed very early in the day on January 2, so this is a rare case of a lawsuit appeal filed and decided on the same day.

The three judges were Patrick Higginbotham and Jerry E. Smith (Reagan appointees), and Andrew Oldham (a Trump appointee).

  12. Don’t know. But I do know, after reading the transcript of Trump’s extortion call to Georgia Secretary of State Raffensperger, that Mr. Trump’s inability to connect subjects or complete cogent sentences indicates classic dissociative disorder. Trump is not well, and the transcript prove it.

    I realize its only 17 more days of the guy; but honesty, Pence, McConnell, Pompeo, Pelosi et al. should invoke the 25th Amendment, Section 4, effective immediately…”the President is unable to discharge the powers and duties of his office”.

  16. Don’t know. What I do know is that Republican candidate Perdue is very misguided about what he selectively finds to be disgusting–i.e. release of the phone transcripts of Trump’s latest attempt at extortion.

    All such calls are in the province of public information under sunshine laws; no expectation of privacy exists for general conference calls of this sort. That Perdue says the call “won’t affect” his upcoming election in Georgia is merely Perdue whistling past the graveyard. Georgians will rally around Georgia against the Tropicana personality cult fanatic who has been attacking Georgia for over two months now. What’s disgusting is Perdue positioning himself to enable said attacks. The damned hypocrite.

    The undertone (not to be confused with Mr. Trump’s desire to paste his face in harlequin orange–camouflage no doubt) is that American military would even feel compelled to make such statements against what can only be called a seditious coup (despite Sen. Cruz’s hypocritical crying about that term).
