11th Circuit Hears Florida Presidential Primary Case

On March 17, the 11th circuit heard DiMaio v Democratic National Committee. This is the case that says there must be some constitutional protection for Democratic voters in Florida, for input into the presidential selection process. The 3 judges seemed to indicate that they will remand the case back to the U.S. District Court. The District Court had ruled that the plaintiff lacks standing.

  1. i voted and it should be counted. they were equal, in that both were on the ballot and neither campaigned in the state. devide the vote up as they do in all primary demo states. percentage to each what they got in the elction . fla is not michigan , where obama wasnt on the ballot. fla had both and that should be it. DNC is stupid and brought this upon themselves. we wanted to vote early, so what??? they dont count our vote, i will vote republican and throw out the dem bums. time to act like grown ups. we all voted, now count it and lets be done with it.

  2. I’m done with both parties. They are so stupid that they can spend 50 million on world poverty and we can’t take care of our VETERANS THAT FOUGHT FOR THEIR COUNTRY. Pure Shameful and I’m ashamed of my country.

  3. While I may not agree with letting the smaller states have their primaries and caucuses first, Florida knew the rules and broke them anyway. There are a lot of people that didn’t vote in Florida because they knew that their vote wouldn’t count, so you can’t take the final tally and say that just because both candidates were on the ballot, the final tally should be accepted as is. The DNC didn’t bring this on themselves. Florida brought it down on their own heads. If they want to perform the “civil disobedience” so to speak, they have to accept their punishment just like any other protester. If the DNC caves in, then they might as well throw all of the rules out the window since people will be violating them knowing they will probably get their way later on. You do the crime, you do the time. If you don’t like the DNC rules, go to another party. That’s what most of us here on this board have already done. Frankly, I’m tired of hearing all the whining for rules that were known, understood and agreed upon by all parties beforehand.

  4. Since there is no constitutional right to vote for President, I don’t see how there is any right to vote for a delegate for President in a partisan primary. I don’t think they’re going to get very far.

  5. This is a primary. The Democratic Party has the right to set rules on when the primary can be held. Florida legislators chose to ignore the rules and created a popularity contest with no delegates instead.

    Candidates ignored the state and voters ignored the polls because they knew that it didn’t count. The outcome does not show the intent of Florida Democrats.

    It is clear that the primary should not count. The Florida Legislators can fix the problem for next time.

    If you want to know who to blame for you lack of representation, blame your Florida Legislators.
