New York Special Congressional Election Too Close to Call

On March 31, New York held a special election to fill the vacant 20th U.S. House seat. The absentee ballots will not be counted until April 6, so no one knows who won. The tally for votes cast at the polling place are 77,344 for Democrat-Working Familes-Independence nominee Scott Murphy, and 77,279 for Republican-Conservative nominee James Tedisco. The third candidate, Eric Sundwall, the Libertarian nominee, was removed from the ballot, although the absentee ballots have his name included on them because they were printed before he was removed.

  1. So it’s quite possible that the Republicans and their Conservative allies kicked Sundwall off the ballot and lost anyway. Serves them right!

  2. Notice: USCA2nd Circ Motion docket 08-4323 Loeber v Spargo re: constitutionality of 20th CD special election result certification challenge

Based upon the NY State Constitution districting article, the 20th Congressional District is unconstitutional. Loeber v Spargo has long awaited a scheduling order to first confirm the need for assignment of a special three judge District Court panel to hear this redistricting challenge. My assembly district overlaps the 20th US Congressional District of New York, contrary to the NY state constitution plan for nested state and federal legislative districting. (Rhinebeck).

I am filing an emergency motion to expedite the scheduling order in Loeber v Spargo and stay the certification of the results of (Tuesdays) special election for the 20th CD

  3. It should be noted that Sundwall endorsed Murphy after he got kicked off the ballot.

  4. NOT having the candidate names on ALL of the ballots ???

How blatant a violation of the EQUAL Protection Clause can there be ???

  5. Have the absentee ballots been counted? If so, how many votes did Sundwall get?

  6. Looks like Tedisco has opened up a 12 vote lead. And absentees lean Republican.

Also, some interesting news breaking that the Dems are repressing overseas Military votes, as they did in the 2000 election in Florida. Can’t have those Military guys voting now, cause as everyone knows they lean heavily Republican.

  7. Mr Dondero, your sarcastic remark about the military leaning Republican is rediculous. I am a 14 yr servicemember. I am a Democrat and for your information. Its officers who are mostly Republican. The enlisted also outnumber the Officers so therefore the military leans Democratic. The truth of the matter is that a Republican President will likely go to war faster than a Dem. Wars are where Officers make there rank. So with that now you see why most Officers are Republicans, not because they agree with the Rep President. They know they will get that next rank definitely.
