Texas Bill, Relaxing Deadline for a Qualified Party to Certify Presidential Nominee, Passes Legislature

Late on the evening of May 27, the Texas legislature passed HB 1193, which relaxes the deadline for qualified parties to certify the names of their presidential and vice-presidential nominees. The old deadline was not met by either the Democratic nor Republican Parties in 2008, but the Secretary of State placed their nominees on the November ballot anyway. HB 1193 sets the deadline as one business day after the national convention of any qualified party adjourns.

  1. I live in Houston 125 miles away from Austin and it smells all the way. What a bunch of electoral wimps the Tx Legistlature is when it comes to any political entity other than one of their two parties. And, of course, let’s not even mentioned the Sec of State’s disregard for the electoral laws of the state.

  2. Obama and McCain shouldn’t have been on the ballot in Texas. Didn’t Bob Barr start a court case about the SOS’s disregard for the law?

  3. Yes there was a court case, but the Texas Supreme Court allowed the Dem/Rep candidates in anyway despite the clear missing of the deadline. The fish rots from the head first here in Texas.
