I’ll go out on a wing and say that they won’t allow this to happen. Without the critical political need, the court will settle into a comfortable don’t want to establish a new precedent mode. This will be easily justified given no explicit provision in law and the unusual circumstances leading into it. Language will be sparse and brief . . .
