New York Court of Appeals Hears Case on Lt. Governor Appointment

On September 11, the New York State Court of Appeals, the highest state court in that state, heard arguments in Skelos v Ravitch, on whether the Governor has the right to appoint a Lieutenant Governor in the event of a vacancy. See this story. The outcome is not easy to predict.

  1. I’ll go out on a wing and say that they won’t allow this to happen. Without the critical political need, the court will settle into a comfortable don’t want to establish a new precedent mode. This will be easily justified given no explicit provision in law and the unusual circumstances leading into it. Language will be sparse and brief . . .
