New York Special U.S. House Election Set for November 3, 2009

New York will fill the vacant U.S. House seat, 23rd district, on November 3, 2009. The race seems likely to be a 3-way contest, because the Conservative Party has its own nominee, and is not cross-endorsing the Republican nominee.

    I need some help. Im in contact with some NY-RTL Party activists who want to reinvigorate their party. Can you give me some specifics on what the signature requirements are, whether they can attain a state voter list (they used to have 40,000+ members), etc?

  2. It’s almost impossible for an unqualified party, or an independent candidate, to get on the ballot for U.S. House in New York special elections. The same 3,500 signature requirement that applies to normal U.S. House elections also applies to special elections. But New York typically forces independent candidates in special U.S. House elections to get all those signatures in 10 days or so. Courts in other states have held that when the normal petitioning time is shortened, states must reduce the number of signatures. No one has litigated that in New York yet.

    The Right to Life Party cannot win the ability to have people register into it, because it didn’t run a candidate for Governor in 2006. If he had done so, no matter how few votes it polled, people could register into it, through 2010.

    So the state has deleted their list of RTL-Voters because they no longer exist? Sad.
