New York U.S. House Seat May be Vacant for Nine Months

On March 6, U.S. House member Eric Massa, who represents New York’s 29th district, said he will resign from the House on March 8. New York election law does not require a special election for a member of the House who resigns at this point in the election cycle. The Governor has discretion as to whether to call a special election. See this story.

The U.S. Constitution does not permit appointments to the U.S. House. If there is no special election, the seat will be vacant until after the November 2010 election.

  2. Like Demo Rep says… see the Hawaii story. Again, if Congress were to strip New York of this seat and award it to a state that CAN and WILL fund a special election (like Utah or Montana) I would bet New York would change its tune very quickly.

  4. How very undemocratic. So who is supposted to represent the people of the 29th District?

  5. An interesting side-note to this issue is that after the Census is completed at the end of this year, New York State is expected to lose a House seat. So whoever does get elected in November may only serve 1 term in Congress. Someone will have to be squeezed out during re-apportionment somewhere in the state.
