Nevada Supreme Court Rejects Citizens Outreach Lawsuit to Remove Scott Ashjian from Ballot

On October 6, the Nevada Supreme Court rejected the lawsuit filed by Citizens Outreach to remove Scott Ashjian, Tea Party candidate for U.S. Senate, from the ballot.  See this story.  If the Citizens Outreach lawsuit had prevailed, that would have had the effect of vastly increasing the difficulty of getting a new party on the Nevada ballot, and would have disqualified the Green Party as well as the Tea Party.  The case is Burdish v Miller, 56795.  The Nevada Supreme Court 5-page decision does not reach the merits of the case, but just says that the lower court was correct when it ruled that a case of this type should have been filed much sooner than it was filed.

The earlier case to remove Scott Ashjian from the ballot is still pending in the State Supreme Court, but it is clear that the decision, when it comes, will not affect this year’s ballot.  The other case is Fasano v Miller, no. 56040.

It’s not a total loss; there’s another lawsuit pending against Ashjian, but even if that one fails, the fact that the ‘Tea Party’ Chairman has quit and endorsed Angle, and also admitting that this “Nevada Tea Party” was just a smoke & mirror group started by Ashjian, being a damaging revelation- in a way, Ashjian is the loser here.

  2. As I’ve said before, had the IAP not squanderd so much time and money trying to get Ashjian of the ballot, the IAP candidate would be polling better. What a sad waste of time.

  3. Wrong! This lawsuit gave our US Senate candidate a LOT of publicity, Fasano would’ve been polling worse then now. The polls only count Ashjian now because they are biased- they are not keeping track of Fasano’s support.

  4. It seems to me that Ashjian is now a household name in Nevada, but Fasano isn’t. These lawsuits have given Ashjian far more publicity than Fasano. The newspaper stories about the Fasano case generally don’t even mention Fasano; they just say that the Independent American Party tried to get Ashjian off the ballot.

  5. Fasano was in the news and on several nevada news stations and was polling at 7% at one time.

    The only reason why Ashjian is getting more attention now is because the liberals here have choosen to champion him and his pathetic cause for political purposes.
