Maine State Court Dismisses Nader Lawsuit Against Democratic National Committee for 2004 Activities

On November 16, a state court in Maine dismissed Ralph Nader’s lawsuit against the Democratic National Committee and its allies, over Democratic attempts to keep Nader off the ballot in two dozen states in 2004.  See this article.  The 20-page decision says the Democratic Party’s activities in 2004 are actions that are protected by the First Amendment.

  1. Will Nader still be unhappy in 2012 — and run again for Prez — in the marginal gerrymander E.C. States — causing the Donkeys to go nuts again ???

  2. Hmm. How does it work that what the Democratic Party and its supporters did was protected under the 1st Amendment but NOT what Nader and his supporters did?

    It all gets back to this odd game that some judges play where sometimes elections are all about the 1st amendment and other times the 1st amendment does not even really seem to apply….
