Rahm Emanuel Candidacy for Chicago Mayor Will Face Legal Challenge on Residency

This Chicago Tribune article reveals that Rahm Emanuel’s voter registration in Chicago was switched to “inactive” status after the post office returned mail sent to the address in Chicago at which he is registered to vote.  Emanuel has been President Obama’s chief of staff but is now the leading candidate for Mayor of Chicago in the February 2011 non-partisan election.  However, the Chicago city charter requires candidates to “reside” in Chicago for the year before running.  Although Rahm can make a convincing argument that his domicile has long been in Chicago, there is a legal difference between a person’s domicile and his or her residence.

  1. How many times in the last year did R take out his Chicago trash and put it into a Chicago dumpster ???

    Once again — each State is a NATION-STATE — with its SOVEREIGN power to define who is an Elector and who is qualified to hold each public office — subject to the restrictions in the U.S.A. Constitution.

    As usual, the moron courts messed up the issue in various durational residency cases.

  3. If you read the article, you need two documents to be a valid voter and eligible to be mayor. A Chicage mortgage and driver license. So Rahm has the mortgage but does he have a Chicage driver licence?

  4. Unfortunately, these residence restrictions for local office have been upheld, even though they clearly would not be upheld if applied to voters. See Chimento v. Stark, 414 U.S. 802, 802 (1973) (upholding New Hampshire’s seven-year residence requirement for gubernatorial candidates); Kanapaux v. Ellisor, 419 U.S. 891, 891 (1974) (affirming five-year residence requirement for South Carolina candidates for governor); Sununu v. Stark, 420 U.S. 958, 958 (1975) (sustaining seven-year residence requirement for New Hampshire state senator).

  6. Poor Rahm, after that shoutout on “The Good Wife” this past Tuesday night. I love that show and I hope they make jokes about his predicament. And I hope he’s disqualified.

  7. # 5 How about having those hoards of unemployed (adults at least) go to a State on the last day of registration and take over such State on the following general election day ???

    Perhaps AK, NV, WY and other places with square miles of empty space ???
