In 2008, the Independent American Party elected the County Clerk of Eureka County, Nevada, Jackie Berg. She was up for re-election this month. On election night she seemed to have defeated her Republican opponent by 376-373. But a recount was held, and the new results are 373-373. The tie will be settled on Friday, November 26, by a card drawing. See this story. UPDATE: the drawing is Friday, December 3.

I hope Jackie Berg is the “lucky” one. But I still can’t help but ask why so close a race? Seems like 4 years ago she won rather handily. Maybe someone closer to the situation can fill us in.

= Yes- she was elected in a 3 way race back in 06′ and her GOP opponent in this race also is a well-known worker in the County Clerk’s office.
Yeah, this was freaken’ crazy and now its going to be a game of chance, rather then the people, who are going to decide this race.
Holy shit I didn’t even know it was legal to decide an election by a card draw.

Is the card law a Nevada thing? I’m pretty sure it is a coin toss in Ohio.

When they mean by ‘drawing cards’ they mean drawing a ticket with a certain number, whoever gets the right, or the closest number wins; its more like a raffle.

In Maine tied primaries are determined by lot, but tied general elections mean a special election will be called, except for Presidential Electors who are chosen by a joint session of the Legislature.

It was a 2-candidate race, a Republican versus the Independent American Party nominee.
I googled up several stories about poker hands (5-card stud) being used in New Mexico. In one case there was a coin flip to determine which candidate got to choose the game of chance.

I’m afraid it’s not over. Those election returns are the original returns, before the recount. I telephoned Eureka County offices today to find out what happened. They said the drawing is not until December 3. None of the county offices answered the phone today except the Sheriff, and the person who answered at the Sheriff’s office gave me that information.
