Utah Legislator, Re-Elected in November 2010, Loses Seat Over Residency

Utah Representative Craig Frank, a Republican, was re-elected in November 2010, but afterwards he himself discovered that he lives slightly outside his district. On January 19, the Republican caucus in the legislature decided not to immediately pass a bill that makes a slight boundary adjustment so as to save Franks’ ability to qualify. See this story.

  1. It is not a slight error. There were 600 voters in the area which was in a new subdivision that was annexed to Cedar Hills. There were 9500 votes total in the house district.

    Since the error also affected the senate and congressional districts lines, those 600 voters were denied the right to vote for their representative in Congress and their legislators, as well as being ineligible to be elected to the legislature. While they could have legally run for Congress, they might have been subject to campaign charges of carpetbagging.
