Wheaton, Illinois, Goes to Court to Prevent Candidate from Being a Declared Write-in Candidate

The city of Wheaton, Illinois, has filed a lawsuit to prevent one particular individual from being a declared write-in candidate for city council. The County Board of Elections accepted his write-in filing, so presumably the city is suing the County Election Board. The issue is the duration of residency for the candidate. See this story.

  1. If there are no declared write-in candidates, then no write-in space would be provided on the ballot.

    City council candidates in Wheaton file with the city elections board, which forwards the names to the county board which actually conducts the election – there appears to be only two offices where candidates file with the county board, while the county elections board conducts elections for a variety of city, village, township, school, library, and parks districts boards (33 pages in the candidate listing).

    The Wheaton Elections Board had ruled the candidate ineligible. It is a flaw in election procedure that there are two filing authorities.
