U.S. Supreme Court Issues Unanimous Decision on Redistricting Principles

On April 4, the U.S. Supreme Court issued this unanimous opinion in Evenwel v Abbott, 14-940. The case had been filed by some Texas voters who argued that the U.S. Constitution requires that state legislative districts should be based on the number of eligible voters in each district, not the population. The Court rejected that idea, and said “one person, one vote” refers to the number of constituents in a district, not the numbr of eligible voters.

The decision does not settle the question of whether a state is free to use the number of eligible voters. The decision is by Justice Ruth Ginsburg.

  1. Pretty easy case constitutionally speaking. I suspect a state could choose some other formula as a constitutional matter under Burns, but it would be difficult to administer. The federal census does not inquire of eligibility to vote, for example, nor does it inquire of registration.

  2. The Texas voters did not argue that congressional districts should be apportioned on the basis of eligible voters. Remember that ‘Wesberry v Sanders’ and ‘Reynolds v Sims’ were decided on different bases.

    The SCOTUS said it is permissible to apportion legislative districts on the basis of population.

    If one were to claim that equal protection under the 14th Amendment required representational equality, then proportional representation and the National Popular Vote scheme would be unconstitutional.

    The purpose of US Census is to apportion representatives among the states under the terms of the 14th Amemdment. Congress is derelict in not inquiring of citizenship status, and whether or not a citizen of the United States over the age of 18 is disqualified from voting, and if so, on what basis.

  3. Too many MORONS to count — esp. in SCOTUS — with its politically correct robot party HACKS.

    Evenwel is the New Age Dred Scott case (1857)– which directly produced Civil WAR I in 1861-1865.

    VOTERS vote — NOT census populations (with instantly obsolete census stats).

    If there is an AREA vote INSIDE a State (such as a vote for a State governor or voting on statewide laws or constitutional amendments), then there is NOT 1 vote for each state senator district in determining results.

    I.E. for MORONS — the structure of the USA Congress has ZERO to do with the election structure of each legislature and the local legislative bodies in each sovereign State.

    For NON-MORONS — each State or Local legislative body exists ONLY because ALL of the Electors-Voters in the area involved can NOT assemble in person and vote on legislative stuff (bills, etc.)

    All in all the Donkey ANTI-Democracy statists will love to continue having ENEMY invaders (aka illegal immigrants) being counted in Census stats to be able to elect Donkeys with less votes than Elephants in the various current totally rigged pack/crack gerrymander districts.

    14 Amdt, Sec. 2 is SUBVERTED in each Census by not asking if each person is a U.S.A. citizen.

    For NON-MORONS — such 14-2 got MOST of the attention in the 1866 debates — i.e. to FORCE ALL States (north and south, east and west) to have universal adult male citizen Electors-Voters — or lose USA Rep and Electoral College seats).

    Means ZERO to the SCOTUS MORONS from judicial Hell.

    Means less than ZERO to the New Age control freak COMMUNIST Donkeys — like Clinton and Sanders — who LOVE having millions of ENEMY invader folks being in the U.S.A. —
