According to this story, the two Colorado presidential electors who lost in U.S. District Court on December 12 have appealed to the Tenth Circuit.

  1. The Tenth Circuit covers not only Colorado, but also Kansas, New Mexico, Oklahoma, Utah, and Wyoming. Not too rich in electoral votes, but 36 in all (currently presumed 22 R, 14 D) would be affected by a decision:

    CO 9 D
    KS 6 R
    NM 5 D
    OK 7 R
    UT 6 R
    WY 3 R

    Of course, as Richard has pointed out in comments elsewhere, the plaintiffs also hope to set a precedent for other states with laws similar to Colorado’s.

    3 USC 5 — about alleged *conclusive* E.C. results

    Why not ONE day after election day or ONE day before the E.C. folks meet ??? — i.e.

    3 USC 5 is one more tyrant law by the HACKS.
