Montana Justice of the Peace Candidate Asks U.S. Supreme Court to Strike Down Law Making it Illegal to Say that he is Endorsed by a Party

On March 7, Mark French, who was a candidate for Justice of the Peace in 2014 in Sanders County, Montana, asked the U.S. Supreme Court to hear his appeal. He has been challenging a Montana law that does not allow him to say that the county Republican Party endorsed him. The lower federal courts upheld the state law. Here is his cert petition.   3. Strictly speaking, it is not a state statute, but rather part of the code of legal ethics, promulgated by Montana court system.

    It appears that it would be legal for the county Republican party to publicize its endorsement of a judicial candidate, or for the judicial candidate to say that he favors the Republican Party.

    Fun Facts: One of the 9th Circuit Panel was a district judge from Nevada. When she was being vetted for appointment by Harry Reid, the partners at her law firm donated $150,000 to the Senate Majority PAC, A Democrat-affiliated group. A month later her name was forwarded to President Obama. She was affirmed by the Senate on a party line vote.

    The chairperson of the Sanders County Republican Party is the wife of the plaintiff, Mark French. He first filed suit in August 2014 claiming that the code of ethics prevented him actively seeking the endorsement of the party. They held a candidate forum, which his opponent agreed to, then withdrew. Afterwards, the party endorsed French, and he then amended his lawsuit to add the claim that he was unable to use the endorsement by the party in his campaign.
