On March 9, a 3-judge U.S. District Court heard oral arguments on which U.S. House districts should be used this year. See this story. One judge suggested that the panel will wait to see what the U.S. Supreme Court does. The proponents of the new districts mentioned that if the new districts were invalidated now, federal law would require Pennsylvania to elect all its U.S. House members in at-large elections.

A court could simply set a new primary date. In Texas in 1996 and 2006 the results from the primaries were set aside, and the general election was held as a special election in new districts. It could happen again in 2018. And congressional elections don’t have to be held in November.
The real reason for an early primary is so that campaigns can hit donors up twice in a year. It also provides more regular employment for campaign managers, pollsters, and others of their ilk.
They mentioned the phone call to the SCOTUS. In 2012, the district court in San Antonio, took a recess to call the DC Court or Appeals to find out when they would be make a ruling on the VRA Section 5 litigation. A couple of hours later, they took another recess to receive a call back from the DC court.
