U.S. District Court Rules Michigan Must Use Straight-Ticket Device While State Appeals

On August 23, U.S. District Court Judge Gershwin A. Drain ruled that Michigan must use a straight-ticket device in the November 2018 election. Earlier he had ruled that the 2016 law abolishing the device is void. The state is appealing, and while the appeal is pending, the state wanted to avoid using the device.

The state will probably now ask the Sixth Circuit for a stay.

  2. Are armies of SCOTUS clerks on 24/7 alert NOW for literal last second appeals/etc. ???

    — since SCOTUS regular first meeting about Oct 1

    — AFTER Nov 2018 ballots are printed in almost all States.

    EVERY election now is a potential Civil W-A-R II event.

    See 1854-1856-1858-1860 elections — and even 1862-1864-1866-1868-1870-1872-1874-1876 elections

    — 22 years of major tensions/exhaustion.

    *some* *normality* in 1878- etc. elections after USA Army left ex-rebel States in 1877 —
    after the 1876 Prez machinations.

  3. Richard, I am trying to recall the history on this because I lived in Michigan until ’98 and remember that then Governor John Engler was instrumental in getting the device removed. That was twenty years ago and IIRC, there was a petition drive to put it back on? Can’t remember, and internet searches only seem to want to show the current news. Thanks in advance.

  4. and BTW, speaking of “devices,” I also remember that elections in the Great Lakes State back then were always by mechanical pull-the-lever devices. Made a very distinct sound when your votes were cast… or if they really were. Have read about rigged machines where gears with greater/fewer teeth were nefariously swapped in.

    ANY 2000 punch card ballot devices lurking around — esp in humid Florida ???

    How many FELONY rigged elections since 1776 in USA

    — using any sort of device — physical or electronic ???

    — only the Supreme Judge knows for sure

    — on Judgment Day ??? !!!
