Some Texas Voting Machines Aren’t Working Accurately

Voters in Texas who use the straight-ticket device are sometimes finding that the device doesn’t work. This year, some voters who push the Republican straight-ticket button end up casting no vote for U.S. Senate. And some voters who push the Democratic button end up voting for Ted Cruz, Republican, for U.S. Senate. See this story. Thanks to Rick Hasen for the link.

As the story says, this is the last year the device is being used in Texas. The legislature repealed it in 2017 but made that change effective after the 2018 election is over. The story does not say, but it could have said, that voters this year should simply not use the device.

  3. Stacy, the United Coalition USA has one plank of four on the Unity Platform which reads “Opposite gender ahead of our own with consecutively ranked alternating genders thereafter”.

    Obviously this is voluntary and the voter is free to pick whom ever they wish. The only way for a voter to decide or address transgender people is by the name on the ballot or other information they may obtain from other sources.

    The United Coalition USA asks that we promote the plan for *ranking* our “opposite gender ahead of our own with consecutively ranked alternating genders thereafter”.

    Simply by promoting our opposite gender isn’t good enough to guarantee 50/50 gender balance in government.

    We must insist on the correct math of “consecutively ranked alternating genders thereafter” in order for the collaboration and mathematics of gender balance to truly work.

    The voting machines displays races on a screen, but it is not a touch screen. Instead it has two buttons to page through races. There were 96 offices and two propositions on my ballot, so there were lots of screens. There is a wheel like a phone dial that is used to scroll through a page. And there is a select button to select a candidate.

    The current race is highlighted. You then scroll to the candidate of choice and press the select button. Your selection is then highlighted.

    After voting in a race, you are automatically positioned at the next race. If you change your selection for a race by making a new selection, your previous choice is unselected so as to prevent an overvote. If you select a candidate a second time, the candidate is unselected. This is the only way to erase a vote.

    When you select a straight-ticket party, all the party’s candidates are highlighted as if you had selected them. As you work down the ballot you can override the party selection by voting for another candidate. If you select your party’s candidate he is unselected.

    This is unlike what happens on paper ballots. The straight ticket box affects the interpretation of the ballot, but does not mark the other boxes. Old-time Republicans remember being told to actually vote for every candidate to prevent Democrat election officials from marking Democratic candidates for individual offices. A big time Democratic election lawyer said there was such a thing as emphasis votes and “make sure” votes. When a voter selected a party-selected candidate a second time his party vote would be canceled for that race. If a voter selected a candidate of a different party then his vote would be switched in that race alone. This was the subject of a lawsuit in Dallas County where it was eventually found the Dallas County should have pre-cleared this aspect of their voting machines. Dallas reprogrammed their voting machines so that voters would be warned if they were trying to not vote for that office and could confirm it. The Dallas County election administrator appealed the lower court decision to the SCOTUS, and was forced out of his position by John Wiley Price and the Dallas County Judge, a Democrat.

    It appears that is someone presses the select button and scrolls the races at the same time, it is being interpreted as scroll then select. In that case it would be as if a Democrat straight ticket voters scrolled down to the senate race and selected the fitst candidate (Ted Cruz, Republican). If they were a Democratic straight ticket voter, this would switch the vote to Cruz. If they were a Republican straight ticket voter, it would simply indo the vote for Cruz.

Back when Harris County was using punch cards, an election official was given the task of looking for hanging chads, which are partially detached votes which might not be counted if they flattened back over the punch. Except he was also looking at a race that a voter had skipped. Let’s say that candidate A was punch 42 and Candidate B was punch 43. While ostensibly examining ballots for hanging chads, he would see that neither 42 or 43 had been punched. He would pretend to be punching out a hanging chad, but instead would be punching out 42 (or 43) based on his favored candidate. This was in a primary so all the election officials would have been party members.

    At the next election, I was in an elevator with another voter and his young son. The lad been given an unvoted punch card. I made a joke about teaching him to punch out additional votes. The father did not think it was funny.

    Harris County used punch card ballots until 2000. The county clerk had been lobbying for replacing the punch card system with the ESlate system that is the basis of this story. They had been told by the Commissioners Court that it was too expensive. After the Florida Fiasco in November 2000 they were asked how much to write the check for.
