Some Arizona Voters Sue for a Special U.S. Senate Election to Fill John McCain’s Seat

U.S. Senator John McCain died on August 25, 2018. On November 28, some Arizona voters filed a federal lawsuit, arguing that Arizona must hold a special election to fill the remainder of his seat before November 2020. The McCain seat would normally have been up for an election in 2022. The Arizona government believes it is constitutional to hold the first special election for the McCain seat in November 2020.

The case is Tedards v Ducey, 2:18cv-4241. Here is the Complaint. The lawsuit’s in-state attorney is Michael Kielsky, former chair of the Arizona Libertarian Party. The case will not be easy to win, because the federal courts in New York ruled in the past that it does not violate the Constitution for New York to have waited to fill U.S. Senator Robert Kennedy’s seat until November 1970. Kennedy died in June 1968.

    17 Amdt- Sec. 2. When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies:  Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.

    One more example/reason to have candidate/incumbent replacement lists

    — NO more vacancy/special election machinations.

    ABOLISH the ANTI-Democracy minority rule USA Senate

    — full of MORON robot party HACKS

    — esp from the below average small States.

  2. Congress should require special elections to be held within 45 days of a vacancy, Texas-style with a runoff 21 days later if necessary. The special election would not be held if the vacancy occurred within 90 days of the end of the term.

    A special election or runoff may be delayed up to 28 days to be held on the same day as a regularly scheduled election.

    No need to amend the Constitution or any other mechanism that DR might have in mind.
