New Mexico Legislature Passes Bill for Automatic Voter Registration and Also Election-Day Registration

On the evening of March 14, the New Mexico legislature passed SB 672. It provides for automatic voter registration, in which each adult citizen known to exist is automatically registered. The individual is then informed and is free to decline. Also the bill allows voters to register at the polls on election day. However, no one can change parties during the 28 days before any primary.   1. So if a person is automatically registered and then declines, could he go to the polls on the primary day and registered to vote into any party? He wouldn’t be “changing” parties.

  4. Brandon, SB 672 doesn’t talk about the ban on people changing parties less than 28 days before a primary. Section 1-4-16, which is not amended by the bill, says, “No designation of party affiliation shall be made or changed on an existing certificate of registration at any time during which registration is closed.” Because 1-4-16 only talks about “existing certificates of registration”, it seems to me that a previously unregistered voter who shows up at the polls on primary day can declare any party he or she wants.

  6. If the US Government kept track of its citizens, this would be greatly simplified. When a US citizen updated their residence, the federal government would inform the state, and the voter would automatically be able to vote (and de-registered in their former residence).

    It could also permit operatioon of internaional federal voting centers in embassies, consulates, military bases, and other locales, where a voter residing overseas could vote in person. ID could be checked, and a message sent to the appropriate State, which would generate a ballot. After the ballot was voted, it would be transmitted back to the US by some secure and timely means.

    It would also simplify the drawing of district boundaries based on the principle of OMOV.
