Crosscut, a non-partisan on-line news service in Washington state, has this article about the two lawsuits still pending on whether states can punish or replace presidential electors who voted for someone other than the person who received the most popular votes in their own state.
The article also explains how irrational it was for the Washington state legislature this year to pass a bill to replace “disobedient” electors, while the Washington State Supreme Court still hasn’t issued its opinion on whether the U.S. Constitution gives electors the freedom to vote for any qualified candidate.
The article quotes Washington State Senator Patty Kuderer as saying that, “so far”, all the courts have ruled that states can control electors. Actually, no court has yet ruled that states may do that. All of the lower court opinions on this issue have ducked the issue, by saying the cases were moot, or that the electors don’t have standing. Kuderer is also wrong to say, “I don’t think that’s what the Constitution ever intended (in reference to whether presidential electors have freedom of choice).” It is clear from the debate at the 1787 constitutional convention that the founders expected the electors to make their own enlightened choice on who should be president.
2016 Trump/Pence — de facto elected — 270 of 538 EC VOTES with 25.7 (repeat 25.7) pct of popular votes — 28 States and ME CD2.
Abolish the super-timebomb EC.

NONPARTISAN APPV – EXEC/JUDIC- PENDING CONDORCET.
Once the duopoly used state legislatures to seize a monopoly of the ballot from individual voters in the 19th century, control of nominations for all candidates from Presidential Electors on down the ticket shifted to the duopoly power elite and they rarely fumble. The only remaining loop hole in the oligarchy’s control of the ballot and election outcomes is the constitutional independence of Presidential Electors – who could potentially revolt against there masters and vote for candidates not on the monopoly ballot!
The Framers structured the election of the Executive Branch a century before the ballots were monopolized to entrench the Democratic and Republican parties. After ballot monopolization control of those two nominations is control of the government in a power-sharing arrangement from which voters have no effective alternative – except the remote legal possibility of voter emancipation by a revolt of Presidential Electors.
Of course, the duopoly can impeach and remove any “outliers” chosen by the Presidential Electors, so this drive to emasculate the Presidential Electors of the constitutional powers seems to me sheer paranoia — unless the voters are becoming more repulsed by duopoly governance than we are told.
The National Popular Vote Plan is an unconstitutional subterfuge to avoid Constitutional Amendment as should have been attempted in the 1880s-90s when the ballot was monopolized.
@DFR,
How does the 1800 election fit in to your model?
The more immediate problem is how the national L.P. convention chooses their Electors and the disconnect from us men and the best female candidates in the Libertarian Party.
It’s clear that the last several elections have been dominated by the egomaniacal chauvinistic psychopaths in the Libertarian Party. Men who slandered and snuffed out the best female candidates like in 2008, the Barr campaigns slander of the Ruwart candidate while implementing his all male team.
That same faction continued the harassment of women and US men supporting them, the national L.P. jacked our candidates, snuffed out our Electors as demonstrated by fewer than 25% female Electors on the California State L.P. Elector list in 2012 and 2016.
Now everything is going to be different because 100% of is men are uniting to change history by voting for a female for POTUS and then to help women elect the right male that they bring as #2.
The United Coalition USA is bringing the 539-party system to the 2020 Elector College in 2020 despite all those males who are nominating males and shunning our effort as a team.
