On July 30, various groups and individuals associated with the Michigan Republican Party filed a federal lawsuit to invalidate the 2018 initiative that set up a non-partisan redistricting commission. Daunt v Benson, w.d., 1:19cv-614. Here is the 32-page complaint. Like the redistricting commissions in some other states, the new Michigan commission lets private individuals draw the district boundaries for U.S. House and legislature.
Applicants for the commission must be devoid of connections to partisan organizations and to partisan individuals. The Michigan lawsuit argues that this policy violates the U.S. Supreme Court decisions that outlawed making government employment conditional on the job applicant’s party. However, those U.S. Supreme Court opinions do not apply to governmental jobs that involve making policy. Thanks to Thomas Jones and Rick Hasen for the news about the lawsuit.

Demo Rep is saying that a party which controls half the seats in a legislature, and wins them by half the vote or less, controls the legislature with 1/4 of the total vote. He also notes that legislators may be elected with 90% of the or 40% of the vote. There is also a gross disparity in the number of voters in different districts. For example, there was a more than 3:1 difference in votes cast among California Assembly districts in 2018.
It is unclear who Mechelle Vinson refers to when she says “we’ve had a lot of success …” she was for a responding to a Demo Rep claim about “RED communist donkeys”.
Incidentally, Michigan has the worst scheme ever invented for a redistricting commission.

21 of 80 California assembly districts have 80% or less of the average votes cast for governor in 2018. MV and EN can get the data from the SOS website and check my math.
In 2018, about 12.465 million voted for governor. That is 155,803 per 80 assembly member. Califoria could set up turnstiles for each candidate. When the quota is reached the candidate is sent to Sacramento. Once the candidate is fully subscribed, they can choose another candidate.

Michigan does not have party registration. If Demo Rep were going to apply he could say he is a Repo Dem. You could not prove perjury. Those who have been visibly active are excluded.
The SOS will make application forms available throughout the state, and also send out 10,000 application to random voters and sending out more if not enough are returned.
Pools of 60 “Dems”, 60 “Rep”, and 80 “Neither” will be chosen by lot with geographic and demographic stratification. This should mean that 5 or so Yupers are among the 200.
Legislative leaders can strike up to 5 each from among all 200.

You are no doubt familiar with the expression about the prosecutor who could get a grand jury to indict a ham sandwich. The commission will be chosen by lottery. Persons who have any sort of useful skills or analytical ability or leadership might not even bother to apply. There will likely be an effort to salt the pools. The UAW will encourage dozens of members to apply.
The commission will then have to hire lawyers and consultants. What is an “accepted measure of partisan fairness”? What does the VRA mean? The lawyers will explain that the commissioners can be sued if their plan does not comply with the constitution.
As Demo Rep notes, the Michigan constitution provides that “political fairness” has a higher priority than county, city, and township boundaries, or compactness. This is code for bacon strips. A district running from Toledo to Isle Royale via Kalamazoo and Flint may be favored if it is “fairer”.
And then there is the inane procedure for determining which plan is accepted.

(d) Districts shall not provide a disproportionate advantage to any political party. A disproportionate advantage to a political party shall be determined using accepted measures of partisan fairness.
(e) Districts shall not favor or disfavor an incumbent elected official or a candidate.
(f) Districts shall reflect consideration of county, city, and township boundaries.
(g) Districts shall be reasonably compact.
