Rocky De La Fuente Files Federal Lawsuit Against New California Law on Presidential Tax Returns

On July 30, Rocky De La Fuente filed a federal lawsuit against the new California law that says no one can be on a presidential primary ballot unless he or she reveals the last five years of federal income tax returns. De La Fuente v Padilla, s.d., 3:19cv-1433. The case is assigned to U.S. District Court Judge Thomas J. Whelan, a semi-retired Clinton appointee. Here is the 18-page Complaint. It says that De La Fuente intends to seek the Republican presidential nomination in 2020. He had filed with the FEC as a candidate for the Republican nomination in May 2019.

  1. Claim 44 is not accurate. The law applies to all primary candidates.

    In addition, California statute does not comply with the California constitution that requires all recognized candidates to be placed on the primary. Excluding recognized candidates who are not seeking nomination of one of privileged hexopoly violates equal protection.

  2. *recognized* = VOID for vagueness = UN-constitutional — USA Amdts 1 and 14.

  3. Merits of this case aside (and I agree with Rocky here), I don’t know if I have seen someone waste more money on politics than Rocky. His approach is so ineffective. He bounces around from party to party and race to race. He could have probably been elected to something by now if he had put that much money towards it.

    Or if he wanted to go the third party route, he could either be a player in one of the third parties or have his own organization with a decent structure. Instead, it is money flushed down the toilet.

    On a side note, is Rocky a progressive, moderate, or conservative?

  4. I believe the California Republican Party will file its own lawsuit fairly soon, and President Trump may be a plaintiff in that case.
