Even though the national convention of the Constitution Party chose Don Blankenship for president at its national convention earlier this month, the New Mexico Constitution Party has nominated Sheila “Samm” Tittle for president. She sought the presidential nomination at the national convention, but was defeated there, placing fourth in the final round.
The New Mexico Constitution Party is ballot-qualified. It will go off the ballot unless it polls at least one-half of 1% for president in November 2020. Tittle is not likely to poll that well. In 2012, when she was an independent presidential candidate, she was on the ballot in two states and polled 2,559 votes in the entire nation.
The Virginia Constitution Party, which is not ballot-qualified, is also considering nominating Tittle, but it has not made a nomination yet. Tittle is listed as a plaintiff in the party’s ballot access lawsuit, but Virginia allows presidential stand-ins, so Tittle is in the case as a stand-in, just as the Green Party also has stand-ins for president and vice-president listed as co-plaintiffs.

I understand that the disaffiliated Virginia CP was somehow able to cast two votes at the national nominating convention – one for Tittle, and one for Kraut, both Virginia residents. But if that state party is disaffiliated and renegade, HOW (WHY!!) THE H did the national party even allow them access to their convention, let alone a seated delegation?!? Obviously their leadership doesn’t give a F about their own rules. Stick a fork in ’em.

I’m so glad I haven’t been active with them for four years. But for all the volunteer work I did between ’04 and ’16, I still feel like I’ve been mugged.
Speaking for ourselves, CP-Idhao does care about our rules. For that reason, absent any unforeseen issues, Mr. Blankenship will be this state party’s presidential candidate. We have yet to decide the VP ballot line. That will done at State Convention in August along with all other necessary state party business.

As you correctly observed, the CP of VA voted to disaffiliate back in 2019.
For a number of reasons they subsequently voted to re-affiliate with the National party and presented their application for consideration.
The vote on the application for affiliation does not take place until the National Committee meeting, which meets after the Convention.
In consideration of this.. the Standing Rules for the convention allow that “any state that has presented an application for affiliation” be allocated 2 delegates at the convention, with 1 additional delegate awarded if the state provides ballot access.
Your not knowing the standing rules does not necessarily translate to our not following or caring about them.
Hopefully this clears things up. Although based on the additional commentary accompanying your questions, my response may be an academic moot point.

The New Mexico Constitution Party will go off the ballot in November 2020 if it runs anyone for president and that person polls less than one-half of 1%. Samm Tittle tells the Constitution Party that she can poll a big vote because she is part Hispanic. However, Rocky De La Fuente was on the New Mexico November 2016 ballot for president, and he only got .06% of the vote in that state.

Although, Mr Fakes disagrees with us and has expressed the opinion that Tittle/Fakes will actually *win* the New Mexico electoral seats this fall. I don’t anticipate that Samm Tittle will even make an appearance in NM during the campaign and I doubt NM voters are as shallow as Mr Fakes seems to believe.
Mr. Blazek, Since your state party is not supporting the national nominee, I would seriously doubt that the National Committee votes to re-affiliate with you. They’d be fools if they did, but then again, that characteristic has already been clearly established.

My state is Missouri.
We are affiliated and we are supporting the national Nominee.
The national committee voted to reject VA’s petition for re-affiliation.
New Mexico is still affiliated.
The NC is not likely to take action against NM as they have not violated national’s rules (although it appears they may well have violated their own bylaws via mis-interpretation).
Whether NM votes to disaffiliate remains to be seen. Mr Fakes has demonstrated that he is unpredictable.
Perhaps Idaho, Virginia and New Mexico will affiliate with each other and form their own party? Their leadership all seem to share a few genetic traits. You have to admit (or not) that it would be an interesting show to watch a rattle snake, a scorpion and a chihuahua in a box trying to dominate and out do each other. *shrug*

If what Mr. Blazek says is true, their convention Standing Rules conflict with the national by-laws (Article IV paragraph 2, clause a).
Besides, by logic alone, the gentleman’s statement admits that their convention’s standing rules sought to work around the national by-laws. When Standing Rules are in conflict with the party’s national by-laws, those by-laws take precedence.
The salient questions to ask are: Were the national by-laws ever suspended? Were the by-laws ever amended to alter the procedural law requiring affiliation? Without answer, the national CP convention will do what e’er it will, irrespective of by-laws. Invent them on the fly, is that it?
Besides, the acolyte Blazek defies credulity. Because by extension, he says the national CP may hand out convention delegate votes to anyone, even before affiliation is granted. That is patently absurd. And then, ex post facto, the convention rules against CP-Virginia’s affiliation after handing them two delegate ballots? Who in their right mind does that?

My reading of (Article IV, paragraph2, clause a) is that it applies to state affiliates. VA was not an affiliate so that clause would not apply to them.

He disaffiliated his state. Any normal person would anticipate that to be the end of things. But not with Mr Whitley. He simply can’t control his obsession with a party, with which he no longer has any affiliation.

What the by-laws say is: “Each state affiliate will be allowed two (2) votes, representing the number of Senators each state is allowed under the U.S. Constitution.”
What the by-laws do NOT say is that nominative ballots are allowed for non-affiliated states.
The by-laws at Article IV are complete upon the point. It sets forth “Number of votes allowed per state”. No where, in the enumerated allowance of convention votes, do they refer to permitting non-affiliated states to receive nominative ballots, in any fashion whatsoever.
As written, the enumerated methods of allowed votes per state, are inclusive and complete. The gentleman Mr. Blazek therefore cannot assume a right to ignore the by-laws and then proffer as his excuse some novel devices and colorful attempts to justify the abuse.
MY reading of what Mr. Blazek is attempting to pass of is that one need not be an affiliated state party (by his own admissions) to receive convention nomination ballots with the national CP. They either lack the understanding of what by-laws are, or more likely know and still don’t care to abide by them.
As to the rest of the gentleman’s noise, that is but a poorly cobbled attempt to deflect from the gentleman’s own ignorance.

Constitutional conservatives are pretty much out of luck. Trump has gone full socialist, Amash decided against running, the Constitution Party is running a guy who is morally liable for multiple deaths even though it wasn’t legally proven, McMullin will probably not run (and even if he does, will get a really late start on ballot access again). Not a very good year to be in that camp I imagine.

Regarding Mr. Blankenship’s expected vote total:
Taking the “bracket” between the linear regression of the past seven general elections and the curvilinear trend line one period forward, yields an estimate range of 207,801 – 240,907 votes. A point estimate would be approximately 226,000 votes.
But this assumes “all things are equal”. And if we know anything at all about 2020, thus far…tain’t so.
One factor to consider is the somewhat cyclical return–i.e. following a high vote take, the subsequent national CP candidate does relatively poorer. So if anything, model estimates should weight lower for 2020.
Tittle is the Presidential candidate for the Constitution Party of New Mexico
because the NM affiliate held their convention after the national party’s convention;
and during the state convention, the CPNM chose Tittle over all other candidates.
The Constitution of the US and the Constitution Party is very big on voting conscience
and the by-laws of the CPNM allow the state party to disagree with the national party
when it comes to putting forth candidates. This freedom is a very good thing
even if it is not always statistically a good move to make.
I support Tittle for President as the best choice (ignoring viability statistics)
because the two party insanity will not change until the people choose to begin to change it.
