Oral Argument Set in Lawsuit Over Voting Rights for U.S. Citizens who Move to Guam

U.S. District Court Judge Jill Otake will hear Reeves v Nago, 1:20cv-433 (U.S. District Court in Hawaii), on August 13 at 9 a.m. This is the case over voting rights for U.S. citizens who move to Guam or the U.S. Virgin Islands. Under federal law, they can’t vote, yet if they had moved to a foreign country, they could have continued to vote absentee in the states in which they had lived before they moved abroad.

  1. They can vote, but only in territorial elections. The best remedy for this would be to exempt territorial residents from federal income taxes.

  2. This is interesting how does it effect Swains Island a guano island attached to American Samoa in 1925. It is an island that was privately owned since 1856 by an American Citizen who purchased it from the British
    Discovering sea Captain.

    “The 2010 census counted 17 people in 6 households. There were 8 males (ages 20 to 61) and 9 females (3 under age 18, 6 ages 18 to 61). There were 11 U.S. nationals (8 born in American Samoa, and 3 in the United States) and 6 foreign nationals (4 born in Samoa, 1 in Tokelau, and 1 in the Philippines). They reported their ethnic origins as 15 Samoans, 1 Tokelauan, and 1 Filipino. Of the 16 people over age 5, 15 spoke mainly Samoan, and 1 spoke another Oceanic language, but all also spoke English.”

    Presumably, the 11 US nationals would be eligible vote in elections in American Samoa, but no where else in the US.

    Where is the person born in Tokelau and when? The islands of Tokelau were all guano islands. The Jones Act applies to the Guano Island and not to American Samoa or Swains Island. The Jennings Family are also from Tokelau as is the current Governor of American Samoa.
    They are all dependents of the King of Bowditch.
