Two Texas Democratic State Senators File Lawsuit to Block Redistricting by the Texas Legislature’s Special Session

On September 1, two Texas Democratic State Senators filed a federal lawsuit to prevent the special session of the Texas legislature from drawing new U.S. House and legislative districts. The Complaint alleges that the Texas Constitution does not permit redistricting in special sessions. And Texas won’t have a regular legislative session until 2023. Eckhardt v Abbott, w.d. 1:21cv-769. The case requires a 3-judge court, and the judges have already been selected. Thanks to Political Wire for this news.

  1. Each State is a NATION-STATE.

ALL State legis = 24/7/365 – ready for action — esp exec/judic machinations and natural disasters.

4-4 RFG = MAJORITY RULE regimes.

NOW 1/2 or less votes x 1/2 rigged gerrymander dists = 1/4 CONTROL = subversion of such 4-4 and 14-1 AMDT EPCL.

  2. They are going to convince a federal court to enjoin the Texas legislature from meeting?

They should have filed in state court.

If there is an equal protection violation it is due to the change in population distribution, not the publication of the census. Courts have been deferential in not demanding updates based on updates but they could, particularly if there is reliable new data.

  3. ALL sorts of stuff in Consts / laws ASSumes *normal* stuff happens on time.

IE on time 2020 Census data — but USA regime failure >>> TX State Const deadline failure.

akin to natural disaster — recent IDA storm >>> crim/civil case schedules totally disrupted for weeks / months / years.

esp NOOO *speedy* trials in USA 6 Amdt cases in LA State.
