On September 30, a U.S. District Court in Texas struck down two Texas election laws that make it illegal for voters to wear “political” clothes at a polling place. Ostrewich v Hudspeth, s.d., 4:19cv-715. Here is the order.

  16. I don’t understand the decision. Houston firefighters had an initiative regarding their pay. They wore bright yellow T-shirts when block walking, and also when electioneering outside the 100 foot limit. Their signs said vote for Prop B, but the shirts merely said Houston Firefighters.

    A wife of a firefighter wore the T-shirt to vote, and was told to turn the T-shirt inside out, which she did and then voted.

    The opinion suggests that this was a reasonable exercise of restriction on political speech within the polling place, but at the same time says that the statute is unconstitutional.

    So I don’t understand the decision.

    The original complaint also had another plaintiff who wore a MAGA hat to the 2018 general election, but that plaintiff withdrew so the opinion does not address the issue.

  28. You don’t think there’s any difference in the security level of in person paper ballots vs in person electronic machine voting vs vote by postal mail vs internet voting?

    If you don’t think all these voting methods are all equally secure, how would you rank them in terms of fraud potential and security level? Do you think the differences are relatively trivial or significant and substantial ? How important do you think it is to keep elections secure and free from fraud?
