Top-Five Proponents Will Petition for a Nevada Initiative

Proponents of a top-five system have filed paperwork in Nevada to circulate an initiative. The idea robs political parties of their ability to nominate candidates, which is the core reason for existence of a political party around the world. It limits the general election to the five candidates who polled the most votes in the primary. The primary would not use ranked choice voting, but the general election would. See this story.

If the initiative passed, it would be much more difficult for a party to remain ballot-qualified. Currently Nevada has a lenient vote test for a party to remain on the ballot: it must poll 1% (of the statewide US House vote) for any of its nominees. But because parties would no longer have nominees (except for president), this method would no longer exist. Instead, parties could only remain qualified by having registration of 1% of the state total. Currently the Nevada Libertarian Party’s registration is only .947%. Top-five proponents have repeatedly written initiatives that make it more difficult for parties to remain qualified. They don’t seem to notice that they could write their proposals to avoid this problem.

The measure will be funded by a group of very wealthy individuals under the leadership of Katherine Gehl of Wisconsin. Thanks to Fairvote for the link.

  1. If the Libertarian Party’s voter registration is currently at .947% it would not be that hard to push it up to 1% or higher, but this is still a bad change to the present law.

  2. The solution is to eliminate party qualification. Let all candidates run as individuals.

    Use a modified trials system like that used in early American elections particularly in New England. A candidate with a majority is elected. If no candidate receives a majority then another trial is conducted.

    Eliminate candidates below a threshold and hold a new election. Repeat as necessary.

    Individual citizens would be free to organize to support candidates.

    I don’t understand why Richard Winger so favors a system that makes the Democratic and Republican parties quasi-official agencies of the state.

  7. When minor parties are qualified, then they can place their presidential nominee on the general election ballot with no petition. And in states with partisan registration, they are typically then listed as a choice on the voter registration form. Also in states with state income tax forms that let taxpayers send a small donation to the political party of their choice, if a party is qualified it will be listed on the state income tax form.

  8. The big problem with an open primary is that a party’s label becomes public property, and anyone can use it on a ballot. At the very least, with an open primary no candidate should be able to use a party label or designation without the party’s permission.

    IMO, approval voting should be used in primaries. Determine which candidates have the broadest support, ans those who obtained a certain minimum number of votes would then proceed to the final election.

    Then, in the final election, use ranked choice voting to determine 1) if there is a Condorcet winner, or 2) if no Condorcet winner, which candidate has the greatest support, after transfers.

  16. Approval voting in the Presidential primaries would be an enormous improvement, especially when there is a large field of candidates. Then, voters who might favor several of the candidates could vote for each of them. And then the delegates from each state could be apportioned by the approval votes for each candidate.

    Pretty weak argument for having a state income tax.

    Presidential candidates should be conducted in the same way as any other election. John Anderson, Ronald Reagan, Jimmy Carter, Donald Trump, Joe Biden, Jo Jorgensen, Howie Hawkins, Woodrow Wilson, Theodore Roosevelt, William Howard Taft, Eugene Debs, et al petition to get on the ballot.

    Why should the government maintain records of the political activities/beliefs of its citizens?

    It does not appear to be a problem in places such as Washington, Minneapolis, Texas, Louisiana, and California that political parties don’t control use of the party name on ballots.

  23. LP-Nevada reached and maintained 1% voter registration when it was run by libertarians, but then the party was taken over by the Mises Caucus.

    People in the Mises Caucus said they would not run candidates against a Republican IF the Republican was a liberty Republican who could pass a pretty strong litmus test, like Rand Paul or Tom Massie. Many Libertarians over the years have said and done the same thing.

    Now as for former Republicans entering the LP, this is nothing new. Many former Republicans have entered the LP over the years. Funny that most of those complaining about the Mises Caucus had no problem with Gary Johnson and Bill Weld coming in from the Republican Party. Not everyone in the Mises Caucus came from the Republican Party anyway, and even out of those who did, they were Ron Paul like liberty Republicans.

    Now as far as voter registration numbers go, those go up and down, and a lot of what percentage the LP is at has to do with other factors. The Democrats and Republicans spent lots of money conducting voter registration and get out the vote drives in 2020 for the presidential election. This spike in their registration totals would have made the LP’s percentage drop. This had NOTHING to do with the Mises Caucus. LP dues paying membership has been going up, and most of this growth is because of the Mises Caucus. The LP of Nevada is not that far off from being at 1% of the registered voters now anyway, so if tgis were to become a problem, it would not be overly difficult for them to get back to 1% of the registered voters or higher, and note that for most of the LP of Nevada’s history, they were under 1% of the voter registrations number.
