Ohio Supreme Court Rejects Legislative Redistricting Plan

On January 12, the Ohio Supreme Court rejected the new legislative redistricting plan. League of Women Voters of Ohio v Ohio Redistricting Commission, 2022-Oh-65. The Ohio Constitution, ever since 2015, has said that the districts must be fair to all political parties. The Court found the plan was not fair to the Democratic Party.   2. The Constitution says that the commission shall “attempt” to draw a plan that was drawn primarily to favor or disfavor a party. It also says that an “attempt” should be made such that the proportion of districts that favor a party should correspond closely to the statewide preferences in statewide preference over the past 10 years.

    But there is the caveat that these stsndards may not override the other provisions including integrity of counties, townships, cities, etc.

    The court says in effect that the a good faith attempt was not made.

    Ohio should go back to the 1850 Constitution with adjustments for OMOV, or use simple weighted voting.

  3. Incidentally, one of the justices is Jennifer Brunner, the former SOS who was sued in Libertarion Party v Brunner. Her actions were more overt than is typical when a SOS is sued in their capacity to administer (allegedly unconstitutional) election laws, since she personally had attempted to craft regulations in lieu of actual legislation.
