New York Times Finally Covers the 2020 Law that Resulted in Only Two Candidates on Ballot for Governor

The New York Times has this story about the fact that no minor party gubernatorial petitions succeeded this year, as a result of the 2020 law that tripled the number of signatures for statewide office, and also increased the vote test for qualified party status from 50,000 votes to 2%. As the article says, a State Supreme Court in Albany is still considering whether to grant injunctive relief to the statewide Libertarian slate. Also the Second Circuit will hear a similar federal case in early September. The article does not mention the Second Circuit case.

The story gives prominent mention to the fact that this is the first time since 1946 that New York has had only two candidates on the general election ballot for Governor. It could have added that 1946 is the only year like that since the beginning of government-printed ballots in 1890.

The Libertarian cases pending in State Court in Albany are Sharpe v New York State Board of Elections, 4989-22, and Hollister v New York State Board of Elections, 4990-22.

  1. I don’t think the article mentioned the fact that this is the direct result of Gov Cuomo’s attempt to restrict access to public campaign finance by independent and third party candidates.

  2. the article does blame Governor Andrew Cuomo, but doesn’t go that deeply into his evolving motivations.

  4. NY should either roll the signature requirement back to 15,000, or triple the circulating time for the 45,000 signatures.

    They could also make it 30,000 signatures, and allow more than 6 weeks for collection, like allow 12 weeks, or better yet, 18 weeks.

    45,000 signatures in 6 weeks is insanely difficult.

  5. There is no reason for New York or any other state to care how early a petition starts to circulate. Most states don’t stop petitions from circulating as early as the proponents wish. Having a very long petitioning period helps grass roots efforts, when the group can’t afford to hire paid circulators.

    It took the California Libertarian Party seven years to get enough registered members to qualify as a party, from 1972 through 1979. The state didn’t care how long it took, which is a good policy.

  8. New York should eliminate the con-fusion party nominations. Let a candidate initially qualify by paying a filing fee ($10?) and the support of 10 individuals. If there are more than 12 candidates for an office, have a secondary period where supporters go to courthouse to register their support. The Top 12 go on the ballot.

    November election day. If no majority, runoff one week later.

  11. The minor party and independent candidates in 2020 not qualifying for the ballot in 2020 if the signature requirement was over 5,000 was due in large part to the COVID restrictions.

    Note that there were ballot initiatives and recalls which gathered in the hundreds of thousands, or a million plus signatures, during the same time frame as the COVID restrictions took place.

  12. The only recall petition recently that gathered hundreds of thousands of signatures was the California gubernatorial recall, and those signatures were mostly gathered before covid.

    We the people elected Trump (twice) to drain the swamp and save America and make it great again. The first time the deep state and fake news evildoers and traitor scum nullified the will of the people with the Russia hoax and impeachment hoax part 1 and 2 and the ridiculous phony china virus plandemic. The second time they just plain rigged and stole the election and put in a dementia ridden puppet for the Chinese and Ukrainian oligarchs.

    So in 2024 when we the people elect Trump again he should be given a twelve (12) year term and it should count as his first term as far as his eligibility. And he should be made the President and CEO of the USA with the power to fire any congressman, judge, governor, mayor etc. As well as any CEO of any American company!

    Then at the end of 12 years we the people get to vote on whether to extend his leadership yet again. By then maybe it will be time to put one of his son’s in charge of the country. Or maybe not quite yet, and we keep Daddy in charge a little bit longer. Either way God bless America and God bless Trump. TRUMP 2024!!!
