Deseret News Story on Forward Party

The Deseret News has this lengthy story about the Forward Party.

It is odd that the story says the Forward Party is trying to get on the ballot in Texas, because petitioning in Texas to put a new party on the bvallot can’t take place in odd years. The Forward Party petition can not be circulated until after the March 2024 primary.

  1. If candidates want to petition to be considered for nomination by convention they can circulate now, and must complete the petition by next December.

  2. But such petitions are worthless if the party doesn’t complete its own party petition. And that petition can’t be circulated until March 2024.

  3. Do any states have rules about whether a signature on a petition can be voided if the person who signed it very early has moved out of state or died?

  4. Usually the voter rolls are just checked for the voter registration status as of whenever they get checked. Although many states do ask for date of signing I have yet to come across any instances of anyone verifying registration status as of that date, except maybe in challenge states where there is an adversarial process over every signature when a challenge occurs. Likewise, although almost all states still require a handwritten signature, supposedly to compare with the voter registration card to verify the person signing was in fact the voter they purport to be, in practice the signatures are rarely if ever compared by state officials, except in challenge states in the event of a challenge. Much more commonly, just the name and address and/or date of birth need to match the voter registration records for the signatures to be counted as valid, except perhaps in cases where everything up and down the page looks like it’s in the same handwriting.

In challenge states, often times just the raw number of signatures needs to be sufficient, unless there is a challenge. However, challenges are becoming more and more common. In the case of a challenge it often comes down to which side has more time and money to press their case, and to some extent to how friendly or unfriendly election officials and/or judges are to one side or the other that is challenging or being challenged.

  5. They have the money to burn. Recall Americans elect. Also why assume the newspaper got everything right? In my experience newspapers often misrepresent or misinterpret what they are told by sources.
