On March 2, the Libertarian National Committee filed a federal lawsuit against Robert K. Dean, a Virginia resident who has been active in a group called the Tidewater Libertarian Party. Libertarian National Committee v Dean, e.d., Virginia, 3:23cv-155.
Here is the Complaint. It says the Tidewater Libertarian Party is not part of the Libertarian Party of Virginia. This lawsuit will be interesting, because it is not clear that the Lanham Act, the federal law involving trademarks, applies to political parties.
Is there a libertarian party in Virginia? I thought I read they committed seppuku?
They did, but then it was started up again.
I am surprised that the Tidewater Libertarian Party did not get sued a long time ago.
Why do they have to be a part of the state or national party? I thought libertarians believe in decentralization? Lol
I guess they lied, they believe in nationalization and central planning after all, at least when they get any whiff of power no matter how minor!!!
Pardon my ignorance. If there was a point where the state party went bankrupt and there was an actual active local group, why didn’t it become the kernel of a new state party? Or, did I misunderstood the facts here?
When will the LNC do a proper ballot access case and a proper gerrymander case ???
Did the LNC ever register a trademark?
Walter, yes. If you read the Complaint, there is proof inside the Complaint.
They’re not against intellectual property ? Lol
@ Antilib:
Intellectual property rights are one of the things that libertarians disagree about.
New Mexico just elected Karen Bedonie chair.
Richard you are absolutely incorrect about Virginia. They did NOT “start back up again .” They never ceased. The records of both the LNC and VA SoS bear this out. That’s also not how things work under LPVA or national bylaws.
PS this suit was authorized under prior LNC – (I agreed to it just want timeline to be clear). The discussions began under Sarwark.
Hey CAH show us your boobies!
I agree with Steve.
Richard Winger is wrong. He always takes the side of communism.
Caryn Ann, why are so many people trying to start fake affiliates?
Garrison, it’s nit really a new thing social media amplifies but silly fights over little power.
Steve, ask my husband. To his face preferably.
Listen Caryn I just want to sniff your hair. Come on man! Not a joke!
I wish CAH would support real libertarians instead of retards and fakes like Gary Johnson and Jo Jorgensen.
CAH I’ll give you $500 for a blowjob
You couldn’t pay me money to do that. She is nasty AF. Is CAH herself posting these comments?
You say the same thing to a tight rope walker as you do to someone getting head from CAH. DON’T LOOK DOWN!
Sarwark is that you comrade?
The culture of sexual permissiveness has spun out of control.
I mean if Ohio State University can trademark the word “The” then why can’t the LP trademark the phrase “Libertarian Party”? Or am I not allowed to call them “the LP” since that infringes on Ohio State’s trademark? There’s a reason intellectual property law is one of the hardest fields to practice in. These things are complicated.
State parties predated national in at least some cases, so national would have a pretty tough time with that.
