Fifth Circuit US Court of Appeals Upholds Texas Electioneering Law

On June 28, 2023, the US Court of Appeals for the Fifth Circuit upheld Texas law barring “electioneering” inside or within 100 feet of an entrance to a polling place, whether it is on Election Day or for early voting, and whether or not the “electioneering” involves an issue, candidate or party that is on the ballot at that time and place.

  1. Why should it apply if it is for a ballot initiative or referendum which is not being voted on in that election?

  2. @Andy,

    There was an initiative on the ballot supported by the firefighters union. The voter had a bright yellow shirt proclaiming that she was a firefighters wife. I believe that during the campaign similar apparel had been worn.

Some people believe voters get confused if they have more than two choices for an office, so someone approaching them on the way to vote about election related things not even on the ballot that day would cause a level of befuddlement that could easily lead to heads exploding like Gallagher watermelons.
