Lawsuit on Former President Donald Trump’s Eligibility to be on Ballots Reaches U.S. Supreme Court

John Anthony Castro is a Republican candidate for president in 2024. He filed a lawsuit in the southern district of Florida earlier this year, asking that the court rule that former President Donald Trump is ineligible to have his name placed on 2024 ballots because he is ineligible under the 14th amendment’s “insurrection” clause. U.S. District Court Judge Aileen Cannon dismissed his case on June 26. Castro v Trump, s.d. 23cv-80015. She only wrote one sentence, saying that he lacks standing without explaining why.

Generally candidates are much more likely to have standing, when the candidate challeges the ballot position of an opponent, than a voter does.

Castro has now asked the U.S. Supreme Court to reverse the district court. Castro v Trump, 23-117. The U.S. Supreme Court has put the case on its September 26 conference.

Normally Castro would be required to appeal to the Eleventh Circuit, but he argues that the issue is too important, and the time too short, for a U.S. Court of Appeals to hear the case. Castro is acting as his own attorney. He had earlier asked the Eleventh Circuit to let him file electronically in the U.S. District Court, because the U.S. District Court had now allowed him to use the electronic filing procedures. Court rules don’t let pro se applicants use the electronic filing system unless the court allows it, and the U.S. District Court did not give permission. The Eleventh Circuit also refused to let him file electronically. Thanks to Ken Bush for the news about Castro’s lawsuit. Castro lives in Mansfield, Texas. Here is his U.S. Supreme Court filing.

  1. Gary, the only “infowars” is the war against information inside your brain. George, thanks for making Gary look smart.

Farmer, given that you’re a swineherd, the biblical metaphor about “casting pearls” applies to you as well as your critters.

  2. Infowars is real news. Retarded commie Satanist trolls like Stock are too stupid to realize this.

  3. There should be a law that states, “If a person, group, or political party challenges another’s ballot access and loses in court they are removed themselves from running in that particular election”.

  4. Real news to whatever extent BOP allows, and a pardon from President Trump on January 20, 2025.

  5. No, you can only challenge their eligibility to be placed on the ballot with evidence that your opponent is not eligible to be placed on the ballot. As far as I know, the 14th Amendment does not stop a voter from voting for an ineligible candidate’s electors, nor does it stop an elector from choosing an ineligible candidate.

OMG you have to read this: “…While Castro is not denying that this action has the potential to elevate his political status, demonstrate his legal ingenuity, and display his executive leadership by single-handedly ending Trump’s political career, Castro’s sole motivation to bring this suit is to remedy an actual injury-in-fact…”

  6. So, hopefully this nonsense will soon be dispensed with. However, your supreme court tends to be cautious, so they might for example, summarily affirm lack of standing. There might thus be various cases along these lines eating up the fevered imaginations of gullible idiots for quite some time. On the other hand, that may be a good thing, as it’s perhaps best if they delude themselves that one of their hare brained schemes will knock Trump out for as long as possible. This will yield maximum reeeee autistic screeching when he takes the oath of office again.

  7. Practically none. A tiny handful may have been caught for the wrong crime, but were nevertheless career criminals..the myth of many wrongly convicted needs to be balanced against the much larger number of non criminals impacted in various negative ways by the prevalence of crime and fear of crime due to coddling of criminals.
