Illinois State Court Rules that Votes for Donald Trump Can’t be Counted in the March 19 Republican Primary

On February 28, a Cook County, Illinois circuit judge ruled that Donald Trump is an insurrectionist and votes for him cannot be counted. It is already too late to remove his name from the ballots for the March 19 primary. The decision has been stayed to give Trump time to appeal. Here is the story from CNN.

The case is Steven Anderson v Trump, 2024 COEL 000013. It is 38 pages and agrees with the analysis of the Colorado Supreme Court. See it here.

Illinois State Court Rules that Votes for Donald Trump Can’t be Counted in the March 19 Republican Primary — 56 Comments

  1. Was it also fascist to block certain Civil War Confederates from taking office?

Socialists commonly set up a one party state, so blocking competition isn’t necessarily fascist. There isn’t a nationalist component to it.

  2. It is astounding how some people will continue to stick to a story even after that story is proven beyond a reasonable doubt to be false.

  3. has any court ever before forbade the counting of votes? It seems on its face to be a denial of the right to vote.

  4. 28 USC 3231
The district courts of the United States shall have original jurisdiction, exclusive of the courts of the States, of all offenses against the laws of the United States.
Nothing in this title shall be held to take away or impair the jurisdiction of the courts of the several States under the laws thereof.

    14-3 Amdt
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

TOO MANY CONLAW MORONS TO COUNT – ESP IN STATE COURTS.

  5. “Andy – Which story are you claiming has been proven to be false?”

The story that J6 was an insurrection and that Donald Trump is an insurrectionist. Reality is that there was no insurrection.

  6. Hopefully this moron will be overruled, but Trump will be nominee and President, and save America, regardless.

  7. There was no insurrection on J6. There was a mini riot of 4% of the protesters against the stolen election who trespassed and engaged in minor vandalism, against the express instructions of Donald Trump, who told them to protest peacefully and legally.

  8. J6- MERE AFTER TRUMP SPEECH PARTY INSIDE THE CAPITOL ???

    HOW MANY DEAD/INJURED ???

HOW MANY CRIMINAL INDICTMENTS/INFORMATIONS // CONVICTIONS SO FAR ???

  9. This judge should be impaled on an electrified spike on the busiest street corner in Chicago.

  10. The moron kangaroo judge should be crucified upside down on live television immediately before the State of the Union speech.

  11. Trump actually offered to call up 10,000 national guard troops to protect the capitol ahead if J6. It was Pelosi who said that would be “bad optics,” even though she lied about it more recently. The demon rats are the insurrectionists. They also stole the 2020 election. Now they’re trying to steal the 2024 election with their bogus banana republic style indictments if Trump and these ridiculous attempts to keep him off the ballot.

  12. It’s absolutely ridiculous to compare J6 to the war between the States, and just as ridiculous to claim Donald Trump ordered anyone to do anything illegal that day. The moron judge is the fascist here.

  13. The scumbag judge should be sentenced to life without parole, hard labor in the penal colony Navalny died in, 140 hours a week making MAGA hats and survival food rations as part of a prisoner exchange program.

  14. Left-wing commie scum want north Korea style one party elections for quisling dictator Beijing Joe Biden under the orders of his fascist daddy dictator Xi Jinping and the CCP. It’s obvious election interference by the demon rats.

  15. This is a cognitive test. If you can’t see this imbecile judge’s fascism, you fail.

  16. Elitist globalist scum taking the people’s champ off the ballot? Surprise, surprise, surprise!

  17. Evil sinister leftist Luciferian slimeball judge needs to be taught a lesson and made an example of.

KEK KEK KEK! KEK KEK KEK! KEK KEK KEK!

    KKK! KKK! KKK!

  18. Andy – An insurrection is an attempt to change the legitimate government by threat or force. They went to DC to “stop the steal”, i.e. to prevent Biden from being certified as the winner so that Trump might continue as president. They were chanting “Hang Mike Pence” and calling for the death of Nancy Pelosi. Numerous people brought various kinds of weapons, including Stewart Rhodes, of Oath Keepers, who was convicted for was bringing in a load of guns. He did not bring them from his hotel room to the capital because he said he was waiting for an order from Trump. He is known to have had a phone call with someone in the White House on that day – not Trump, but someone with immediate access to him. Other people were arrested with rifles and something described as being similar to molotov coctails in their vehicles which were parked nearby. Other people were arrested for using flag poles as weapons, some of which had pre-sharpened ends, which indicates premeditation. Someone else was arrested with a flag wrapped around an ax handle to disguise it.

What else do you need to see in order to identify Jan 6 as an actual insurrection attempt? At least some people literally said they were there for that purpose and brought weapons with the intent to accomplish the task. Granted, most people there had no weapons and were just playing the role of useful idiots, giving the perception of large numbers to the smaller number of people who intended to use violence. But, there were a number of people who went there with the intent to use violence to stop the transfer of power and they reportedly had contacts with Trump’s immediate circle of associates.

  19. If Trump votes are not counted on March 19th than Nikki wins the state for GOP and delegates. hahahahaha

  20. This retard judge gives hope to all retards everywhere. If a retard just like us can be a judge, what can’t a retard do?

  21. Some of the strawman fake Trump supporters do have a point.Trump should no be removed from ballots. He had nothing to do with the riot.

  22. Straw man fake Trump supporters? Who’s that? I don’t see any of those. Who’s a fake Trump supporter or using straw men arguments in your opinion?

Trump appeals Illinois judge’s ruling removing him from primary ballot
Judge Tracie Porter had ordered Trump’s removal from presidential ballot for his role in the US Capitol attack

Donald Trump has appealed a decision from an Illinois state judge who decided he should be removed from that state’s ballot because of the 14th amendment, an ongoing issue for Trump in the courts.

Tracie Porter, the Cook county circuit judge, made the decision on Wednesday, reversing the previous decision by the Illinois state board of elections, which said Trump could stay on the ballot. The order was put on hold pending an appeal from Trump, which came swiftly on Thursday.

The Illinois decision came after the Colorado supreme court ruled similarly, saying Trump couldn’t hold office again because he had participated in an insurrection while an officer of the United States. Another decision in Maine, by the state’s secretary of state, decided to keep Trump off the ballot there as well, though that is now on hold.

The Colorado decision went before the US supreme court in February, which has yet to rule on the case, though the justices expressed a load of skepticism of the claims that Trump shouldn’t be allowed to run again.

STAY TUNED FOR 24/7 COURT ACTIONS DUE TO DEADLINES TO PRINT BALLOTS.

  24. Hmmmm..
How many others here see all the straw men, assumptions and nonsense in Jim version of events?

  25. @Jim,

Insurrection is a crime 18 USC 2383. Have there been any convictions? Have there been any indictments?

It appears that the goal is to decide the penalty, and then work backwards to find a crime.

  26. They went to DC to stop the steal – who is they? Tens of thousands of people went to DC to peacefully and legally protest the election theft. This is a fact.

We can disagree whether the election was actually stolen. You can’t dispute the fact that the vast majority of those who went to the protest did nothing illegal, and merely exercised their constitutional rights, regardless of how much you agree or disagree with their cause.

It’s also a fact that Trump publicly said protest peacefully and legally. This is on the record. Tens of thousands of people, including me, were there to hear him say it. There’s video and audio recordings. The speech text is published. It’s indisputable.

Likewise, it’s a fact that Trump publicly, on the record, on live TV, called on J6 rioters to cease and desist. I was not a J6 rioter. I was back in my airbnb and watched him say it on TV. But you can’t claim he didn’t say it. He said it.

At most, you can quibble it took him too long. How do you know what else he was doing as President during that time? Maybe the secret service had concerns for the president’s safety? Maybe he had other job responsibilities? At most, you have unverified, unproven, quite possibly biased or even false accounts of what he was doing.

  27. They were chanting hang Mike Penis and calling for the death of Nancy Pelosi.

How many people chanted that? How many of those were actually serious and meant it literally? This isn’t the same they as Jim’s first they, which was tens of thousands of people (including me).

I was part of the 99% or more who did not chant hang Mike Pence or kill Pelosi.

  28. Numerous people brought various kinds of weapons – how numerous? Any numbers you can solidly prove?

Mea culpa: I was there at Trump’s speech, which was not at the capitol. I had weapons in violation of DC law, but did not carry them to the rally. I didn’t go to the capitol (the vast majority didn’t).

The illegal weapons were in case of widespread chimping or rioting by DC natives and paid provocators. I had no intent of using them to commit any crimes other than violating unconstitutional DC legal edicts, and did not use them at all.

I did have a few legal objects which could be used as weapons at the rally, in case I needed them for self defense against antifa commie scumbags. No such necessity presented itself.

  29. Stewart Rhodes claims he was waiting for an order from Trump to use weapons.

No doubt he claimed that. He may have even believed it. Maybe he even still believes it. It’s highly unlikely that you have any way of assessing the likelihood that any such orders could have been forthcoming.

I tend to think that if Rhodes thought it was a realistic probability, he was delusional. The only indisputable fact is that no such order was issued. There’s a whole lot of room between criminal convict and inmate Rhodes claims he believed he might receive orders on the one hand, and President Donald Trump may have been on the verge of issuing such orders on the other.

David Berkowitz may have been hearing orders from his neighbor’s dog Sam. Charles Manson may have thought he had coded instructions in Beatles lyrics. John Hinckley may have thought that Jodie Foster would go out with him if he shot President Reagan. As far as I know those claims don’t make the pooch, the British pop band, or Ms. Foster guilty of any crimes.

  30. Stewart Rhodes is “known” to have had a phone call with “someone with immediate access to” President Trump that day.

How do we know this? What are your sources? How reliable are they?

If they are reliable, who made this claim? Why should we believe him, her, or them?

If we presume the claim is accurate, it doesn’t tell us much. There are usually lots of people milling around anyone at that moment serving as US president. Many of these people take numerous phone calls from a wide variety of people.

Stewart Rhodes is, and was then, a moderately famous guy and relevant to what was happening that day. I’d have probably taken his call that day if I was a journalist, law enforcement officer, had anything to do with presidential protection, etc, etc.

There are several logical leaps between taking someone’s call and being involved with them in a criminal conspiracy. There are more leaps between someone with immediate access to the President taking a call and the President being involved in a criminal conspiracy.

Who took the call? What was the substance of the call? How do we know this even happened? How about facts instead of insinuations?

  31. Various people were arrested with various weapons. Numbers, please. How many people, with how many weapons?

There’s also the fact that, as someone already mentioned, having a weapon and using, or intending to use it, to help overthrow the government are in fact two different things. That’s even true when there is a tiny handful of people in the vicinity who in fact do have weapons for such a purpose (but nothing even remotely approaching a realistic plan for such).

  32. There were a number of people who brought weapons with the intent of preventing the transfer of power. Yes, that’s true. That number, to the best of my knowledge, was in the single or at most double digits.

If you have evidence to the contrary, please do present it. Otherwise, you have something about as realistic as the antifa “autonomous zones” which claimed to have seceded from the federal, state and local jurisdictions they were under several months earlier, and somewhat less destructive of federal and other government property, etc.

“They reportedly had access” to Trump’s inner circle. More specifics, please. Who were they?

Above you named one person, Stewart Rhodes. Were there others? Who were they? How many of them were there? What was their level of access, to which Trump associates? How do we know this? Where was this reported? And why should we believe them?

How do we go from all these unproven allegations and maybes to Trump himself being an insurrectionist and being denied ballot access?

Sounds like bullshit to me, and I lay heavy odds on the Supreme Court agreeing with me in an overwhelming fashion.

  33. Was it also fascist to stop Confederates from taking office?

In a sense yes, because the Confederacy had every to secede under the logic of the 9th and 10th amendments, Declaration of Independence, and original understanding of ex post facto laws before they were wrongly held to only apply to criminal matters.

Fascism has a more specific meaning, but even so, Lincoln was in many respects a proto-fascist.

  34. One party states aren’t necessarily fascist. True, but today’s demon rats are quite fascist. There is a very nationalist aspect in that they seek to centralize power in the hands of a national government to the point it’s no longer federal. They hate local control of anything.

Like true fascists, they want government heavily involved in and manipulating all other social institutions (at least until they can eliminate them) – business, family, charity, unions, educational institutions, religious groups, civic associations of all kinds.

    They love glorifying the young and new and “progress” and wiping out tradition, faith, etc;

Nowadays, they’ve even come to love the national security state and foreign intervention again.

In what ways are they NOT fascist? I’m struggling to come up with any.

Face it: Biden and his party are fascist.

And now they are openly trying to kick all competition off the ballot, not just third parties and independents.

Communism is their ultimate goal, but they are currently at a stage which is more like fascist than anything else. It’s really the best word for what they are.

  35. Jim Riley – The Colorado district court ruled Trump engaged in insurrection by a preponderance of evidence. A criminal conviction isn’t needed for a civil court case to determine guilt. See OJ Simpson.

The House Select Committee on January 6 made a criminal referral for Trump to be charged with 18 USC 2383, but he hasn’t yet been formally charged with that. The evidence they used for that referral is in their report.

Someone who commits a murder is a murderer in fact, regardless of whether or not they are later convicted. Jefferson Davis was never convicted of anything, either, but no one, including Davis himself, denied that he was barred from holding office even in the absence of a conviction. If you wish to argue, like Richard Winger, that the applicable penalty applies to being prohibited from being sworn in, rather than prohibited from running for office, I can accept that.

While no one has yet been charged with 18 USC 2383 (Insurrection), at least 14 people (9 Oath Keepers, 5 Proud Boys) have been *convicted* of the substantially similar 18 USC 2384 (Seditious Conspiracy). The difference between them is that seditious conspiracy involves plotting the violent overthrow of the government, and requires the state to prove that actions were taken in furtherance of that plot, while insurrection involves the actual act itself. It’s different stages of the exact same crime. The argument that no one has been convicted of insurrection is junk because there have been convictions for seditious conspiracy.

  36. House select committee made a referral – that’s a long, long way from a criminal conviction.

Someone who commits a murder – you’re working backwards. What about someone falsely accused of murder?

Jefferson Davis obviously engaged in an insurrection. There’s nothing obvious about the claim that Trump did. Lots of people asked questions to dig into that claim above. Jim has no answers, or has not bothered to provide any at least.

No one has “yet” been charged with insurrection? Any evidence that anyone ever will be?

Also, a charge is not a conviction.

Despite being similar, there’s a reason why seditious conspiracy and insurrection are two separate and distinct charges.

Notice that Donald Trump is NOT one of the people convicted of or charged with seditious conspiracy, much less insurrection.
