Jamie LaBranche is an independent candidate for U.S. Senate in Louisiana this year. He was unable to meet the new ballot access requirements for independent candidates. The law required 2,500 signatures, due February 13, and only voters who are not registered in a qualified party can sign the petition. He has filed a pro se federal lawsuit, LaPlace v State, m.d., 3:26cv-139. Here is the Complaint.

It appears that the relief he seeks is to restore the Open Primary.

It’s a type of knee jerk reaction to say he is asking for an Open Primary.
He is literally asking for easier ballot access because the state election system heavily favors the candidate who comes out of the primary of the dominant political party. The courts refer to this situation as an outcome determinate primary. This is another way of saying that the election system is structured to be a monopoly where the primary winner is the general election winner 100% of the time.
An open primary doesn’t fix this. Reduced barriers to ballot access might. Private primaries or nonpartisan primaries where the state isn’t deciding the primary winner is ultimately the best fix.

HB 17 (2024, 1st session) implemented the closed partisan primaries for congressional elections. He is seeking an injunction against enforcement of HB 17. If there is an injunction, the law will revert to the Open Primary.
