On April 27, the Virginia Supreme Court heard oral argument in Scott v McDougle, 260127. This is the lawsuit that originated in Tazewell County. The lower court had ruled that the new districts approved by the voters are illegal and void. The hearing lasted one hour. Two justices seemed critical of the new districts, but the other justices said very little. See this story.

This nation wide, partisan effort to redistrict may result in the creation of more competitive districts, as both major parties spread themselves thin across a number of states. We saw some of this in New York in 2024 when the Democrats lost a number districts after trying to maximize their seats with redistricting.

According to the local ABC (fake news) affilliate,
“The Supreme Court of Virginia has denied a request from Democrats and the state to pause last week’s ruling by a Tazewell County judge, which blocked the State Board of Elections from certifying the results of the April 21 redistricting referendum.” (End of fake news source quote)
Tazewell County Circuit Judge Jack Hurley had already blocked the Gerrymandering scheme before this vote, ruling that the whole thing was illegal on procedural grounds and that changing congressional districts this way required following strict constitutional amendment procedures.
This was almost inevitable, but we’re pretty stoked that the Virginia Supreme Court came through on this one!
