On June 8, Ohio Supreme Court Justice Jennifer Brunner filed this brief in Brunner v LaRose, n.d., 4:23cv-2180. Brunner is a Democrat who argues that the label “Democrat” should not be placed on the November ballot next to her name (she is running for re-election). Alternatively, she argues that if “Democrat” will appear next to her name on the November ballot, the judicial rules for candidates for judicial office that bar them from discussing public policy issues should be set aside. In other words, if she must have “Democrat” on the ballot next to her name, she wants to be able to defend political ideas associated with the Democratic Party.

Homeland Security retreats on plan to get data on mail-in voters

The U.S. Department of Homeland Security is walking back, for now, a plan to sweep up data on millions of Americans who vote by mail under President Donald Trump’s executive order restricting mail ballots.
In a federal court filing Monday night, the Justice Department significantly hedged the data-sharing plan, pulling back from a position the Trump administration advanced last week.
DOJ lawyers now cast the idea as in the early stages and dependent on approval of a new U.S. Postal Service rule for mail ballots, citing a memo that Homeland Security Secretary Markwayne Mullin signed earlier Monday.

Ohio used to have partisan primaries for appellate judges including the Ohio Supreme Court, but on the general election ballot there were no party labels, so a voter might see:
[ ] Tom Jones
[ ] Joan Thomas
Back in 2004, there was a nut case who claimed that Bush had stolen the popular vote in Ohio, because a Democratic judicial candidate had run well ahead of Kerry. This proved that the GOP had done a sloppy job of vote manipulation because anyone who would vote for Kerry would also vote for the Democrat Jones …umm… Thomas or just vote for the one who sounded like the judge in your divorce trial depending if you won or lost.
In 2020 Jennifer Brunner was elected to the Ohio Supreme Court as the Democratic nominee without a D next to her name, running well ahead of Biden who had a D next to his name. Perhaps voters were familiar with Brunner’s name when she had been elected as Secretary of State.
In 2022 the law had changed when Brunner ran for chief justice with a D next to her name and lost.
In 2026 she wants to run again without the D next to her name; alternatively she wants to be able to campaign explaining why she is a D, which for a judicial candidate is a big no no, since it indicates that they have prejudged a case that will come before them.
