Alaska State Trial Court Puts Daniel J. Sullivan Back on Primary Ballot

On the evening of June 26, an Alaska state trial court put Daniel J. Sullivan back on the primary ballot as a Republican candidate for U.S. Senator. See this story. There will be an appeal to the State Supreme Court.

  1. That was quick. Our Judicial branch can move very fast when it wants to.
    Made my friend wait 2 years for decision not worth the paper typed on.

  2. The Alaska Supreme Court will hear the appeal on Monday morning (10 AM AKDT (UTC-8)) The two parties (e.g. Dan J. Sullivan and Department of Elections) filed a joint motion on Friday evening for an expedited hearing. The parties had asked for 24 hours for each. The Court shortened this to 21 hours.

    Justice Dario Borghesan has recused himself. He did not give a reason. My guess: he listed Senator Daniel S. Sullivan as one of his two character references on his application for appointment to the court. This is distinct from the references for professional competence and qualification. Borghesan worked for the Attorney General (Department of Law) for about a decade. This overlapped for a short while when Sullivan was AG.

    The State of Iowa on behalf of 13 states (and their respective Republican parties – my inference, JR) has submitted an amicus brief arguing that states have a right and obligation to protect election integrity (i.e., according to the brief, no Iowan or Alaskan should be denied the right to vote).
