Alaska Supreme Court Unanimously Keeps Dan J. Sullivan on Primary Ballot

On June 29, the Alaska Supreme Court issued a one-page order, agreeing with the lower court and keeping Dan J. Sullivan on the August primary ballot as a Republican candidate for U.S. Senate. The Court will issue an explanation at a later time. The decision is unanimous.

  1. The Alaska Supreme Court affirmed the decision of the Superior Court, and remanded the case back to the Division of Elections to determine how the two will appear on the ballot.

    The hearing took about 20 minutes, mostly consisting of questions from the justices. The memorandum opinion was issued about three hours later, with a full opinion promised for some time in the future.

    If this were Texas, the following description would be used.

    Sec. 52.032. CANDIDATES WITH SAME OR SIMILAR SURNAMES. (a) If two or more candidates for the same office have the same or similar surnames, each of those candidates may have printed on the ballot a brief distinguishing description or title, not to exceed four words, following the candidate’s name.

    (b) The description or title may only refer to the candidate’s place of residence or present or former profession, occupation, or position. However, the description or title may not refer to a public office.

    For example: Sullivan, Dan (Petersburg, Retired School Teacher) and Sullivan, Dan (Anchorage, Attorney)

    The Division of Elections. Alaska does not have a Secretary of State. Instead the administration of elections is under the Lieutenant Governor. In addition, Alaska elections are administered by the State rather than local entities.

    Alaska statutes state that the Director (of the Division of Elections) shall prepare the ballots.

    “Alaska Statutes 15.15.030. Preparation of official ballot. The director shall prepare all official ballots to facilitate fairness, simplicity, and clarity in the voting procedure, to reflect most accurately the intent of the voter, and to expedite the administration of elections.”

    The Division of Elections twisted this into meaning that voters might unintentionally vote for the wrong Dan, and that would not be fair and would disenfranchise voters. The simplest solution would be to exclude Petersburg Dan from the ballot. Isn’t that clear?

    In my personal experience, while the initial colloquial naming rights usually belong to a young child’s family, the nicknames that tend to stick are usually bestowed by classmates in school. Some people also try to reinvent themselves by changing or ditching such nicknames during adulthood, with varying degrees of success.
