It was the Republican Party that stimulated the effort to keep Legiua off the ballot. The New Jersey Seventh District US House race involves incumbent Republican Thomas Kean, who was recently absent from Congress for four months but returned to the US House on June 30, 2026 and explained that he had been treated for depression.
Here is the opinion which says the plaintiff has been wrong. It also says the Court is not reaching the constitutional issue because the case was already in state court.

So the NJ administrative judge said that the law was probably unconstitutional, but as part of the executive branch it was inappropriate for him to rule on it. Instead he ruled based on the statute, but teed it up for the SOS to overturn his decision. The SOS did reverse the decision. But then a NJ appellate court ruled that because the AG in representing the SOS had failed to say that the SOS was making his ruling based on constitutional grounds.
And now the federal district court is ruling that the it does not have jurisdiction because Leguia is attempting to overturn is attempting to overturn the administrative court decision, which was substantively that he did not have the authority to rule on the constitutional issue?
New Jersey now has a food shortage.
