Alaska Files Brief in Lawsuit Over Two Candidates with Similar Names for U.S. Senate

On October 26, Alaska filed this brief in U.S.A. v State of Alaska, 3:26cv-376.  It leans heavily on the fact that the two Dan Sullivans listed on the ballot can be distinguished from each other.  The incumbent and the other Sullivan have different middle initials.  The incumbent has “Republican” next to his name, but the other Sullivan does not.

  1. Wow, the motion clearly shows the ballot design of just one line for Daniel J. Sulivan, Jr.of 18 August 2026 while all the other candidates in that 18 August 2026 election had two lines. Thereby “Sullivan, Daniel J. Jr.”, was given a ballot design favor according to the ballot design class at the Law School at Stanford Jr. University. That 18 August 2026 ballot was illegal under Alaska Law.

The Election Division will not state who approved that ballot with just one line for “Sullivan, Daniel J. Jr.” When all other candidates had two lines. The four thousand plus advantage to Daniel J. Sullivan,Jr. was caused by the Election Division and not by the names of the Sullivan candidates.

This is not thst uncommon with two or more people running for office with the same name.

What is a concern is one candidate paying to place another candidate on the ballot to take away votes from another candidate. This was the case in the 11th Congressional District of Massachusetts in 1946. That year JFK (later POTUS in 1961) paid Joseph Russo to file for the same seat in the Democratic Primary so the other Joseph Russo could lose votes on the ballot for confusion.

Then in 1954 in the California Senate
race for all of Los Angeles County, Senator Jack Tenney paid out of his own campaign funds the filling fee of H. Younger to run in the Republican Primary election to take votes away from Mildred Younger who was the Republican Party plant to run against Senator Jack B. Tenney, because he ran against Richard Nixon in 1952 for VPOTUS in both Missouri and Texas on a ticket with General Douglas MacArthur for POTUS.

Mildred Younger made the nomination speech for Ike Eisenhower at the GOP Convention in 1952 and Jack B. Tenney wrote the song “Mexicali Rose” which was song by both Gene Autey and Jerry Lee Louis.

The crime here was committed by some one at the Alaska Elections Division to assist Daniel J. Sullivan, Jr. to take votes away from other candidates in that jungle 18 August 2026 primary.
